ORDER OF DISMISSAL

By the Chief, Market Disputes Resolution Division, Enforcement Bureau:

1. On August 1, 2018, Missouri Network Alliance, LLC filed with the Commission a formal complaint (Complaint) Formal Complaint, Proceeding No. 18-236, Bureau ID No. EB-18-MD-004 (filed Aug. 1, 2018) (Complaint).  The Complaint was filed to effectuate a primary jurisdiction referral from the United States District Court for the Western District of Missouri.  See Complaint at 3, para. 8, 9-10, paras. 34-35. 
 against Sprint Communications Company L.P. (Sprint) pursuant to section 208 of the Communications Act of 1934, as amended (Act),  47 U.S.C.  208.
 alleging that Sprint violated Section 201(b) of the Act. 47 U.S.C.  201(b).  Sprint answered the Complaint on August 29, 2018. See Answer of Sprint Communications Company L.P., Proceeding No. 18-236, Bureau ID No. EB-18-MD-004 (filed Aug. 29, 2018).
  
2. On April 17, 2019, the parties jointly filed a motion to dismiss the Complaint. Joint Motion for Voluntary Dismissal with Prejudice, Proceeding No. 18-236, Bureau ID No. EB-18-MD-004 (filed Apr. 17, 2019) (Motion to Dismiss).
  In the Motion to Dismiss, the parties state that they have resolved the disputes giving rise to the Complaint and request that the Complaint be dismissed with prejudice. See Motion to Dismiss at 2, para. 5, 3, para. 7. 

3. We are satisfied that granting the Motion to Dismiss will serve the public interest by promoting the private resolution of disputes and eliminating the need for further litigation and the expenditure of additional time and resources of the parties and this Commission.
4. Accordingly, IT IS ORDERED, pursuant to sections 1, 4(i), 4(j), 201(b) and 208 of the Communications Act of 1934, as amended, 47 U.S.C.  151, 154(i), 154(j), 201(b) and 208, and the authority delegated in sections 0.111, 0.311, and 1.720 - 1.736 of the Commissions rules, 47 C.F.R.  0.111, 0.311, and 1.720 - 1.736, that the Motion to Dismiss is GRANTED, and that the Complaint is DISMISSED with prejudice.
