Adopted: May 4, 2017 Released: May 4, 2017
By the Acting Chief, Market Disputes Resolution Division, Enforcement Bureau:
1. On June 24, 2016, Farmers Bank, Windsor, Virginia (Farmers Bank) filed with this
Commission a formal complaint against Verizon Business Network Services Inc. and MCI
Communications Services, Inc. d/b/a Verizon Business Services (collectively, Verizon) under section 208

Complaint on October 14, 2016.2
2. On April 25, 2017, the parties advised the Commission that “all matters in controversy

1 Formal Complaint, Proceeding Number 16-211, Bureau ID Number EB-16-MD-002 (filed June 24, 2016)
(Complaint).
2 Answer of Verizon Business Network Services Inc. and MCI Communications Services, Inc. d/b/a Verizon
Business Services, Proceeding Number 16-211, Bureau ID Number EB-16-MD-002 (filed Oct. 14, 2016) (Answer).
The parties jointly requested – and staff granted – a number of extensions of the deadline by which Verizon was
obligated to file its answer so that the parties could discuss settlement. After Verizon filed its Answer, staff granted
the parties’ additional joint request that the Commission suspend any future pleading deadlines while the parties
finalized a settlement agreement.
3 Letter to Lisa B. Griffin, Deputy Chief EB/MDRD, from Kelley C. Holland, Counsel for Farmers Bank,
Proceeding Number 16-211, Bureau ID Number EB-16-MD-002 (filed Apr. 25, 2017). We consider Farmers Bank’s
request to be a motion under rule 1.727. See 47 C.F.R. § 1.727 (“A request to the Commission for an order shall be by
written motion, stating with particularity the grounds and authority therefor, and setting forth the relief or order
sought.”).

3. We are satisfied that granting the Motion will serve the public interest by promoting the
private resolution of disputes, eliminating the need for further litigation, and conserving the resources of
the parties and this Commission.
4. Accordingly, IT IS ORDERED, pursuant to sections 1, 4(i), 4(j), and 208 of the
Communications Act of 1934, as amended, 47 U.S.C. §§ 151, 154(i), 154(j), and 208, and Commission
rules 0.111, 0.311, and 1.720-1.736, 47 C.F.R. §§ 0.111, 0.311, and 1.720-1.736, that the Motion is
GRANTED, and that this proceeding is DISMISSED WITH PREJUDICE.
