FORFEITURE ORDER
Adopted: April 23, 2014 Released: April 24, 2014
By the Regional Director, Western Region, Enforcement Bureau:
* This is a Forfeiture Order (Order) assessing a $4,200 penalty against Coastal Television Broadcasting Company LLC (Coastal), for its over four-year failure to file required information with the Commission regarding its ownership of a registered antenna structure used for telecommunications.
* In this Order, we issue a monetary forfeiture to Coastal, owner of antenna structure number 1004021 (the Antenna Structure), in Anchorage, Alaska, for willful and repeated violation of Section 17.57 of the Commission's rules (Rules). The noted violations involved Coastal's failure to notify the Commission upon a change in ownership information for the Antenna Structure prior to notification to do so by FCC agents.
* On October 25, 2013, the Enforcement Bureau's Anchorage Office issued a Notice of Apparent Liability for Forfeiture (NAL) in the amount of $4,200 to Coastal. Coastal has not filed a response to the NAL. Based on the information before us, we affirm the forfeiture.
* ACCORDINGLY, IT IS ORDERED that, pursuant to Section 503(b) of the Communications Act of 1934, as amended, and Sections 0.111, 0.204, 0.311 and 1.80(f)(4) of the Rules, Coastal Television Broadcasting Company LLC IS LIABLE FOR A MONETARY FORFEITURE in the amount of $4,200 for violations of Section 17.57 of the Rules.
* Payment of the forfeiture shall be made in the manner provided for in Section 1.80 of the Rules within thirty (30) calendar days after the release date of this Order. If the forfeiture is not paid within the period specified, the case may be referred to the U.S. Department of Justice for enforcement of the forfeiture pursuant to Section 504(a) of the Communications Act of 1934, as amended. Coastal Television Broadcasting Company LLC shall send electronic notification of payment to WR-Response@fcc.gov on the date said payment is made. The payment must be made by check or similar instrument, wire transfer, or credit card, and must include the NAL/Account Number and FRN referenced above. Regardless of the form of payment, a completed FCC Form 159 (Remittance Advice) must be submitted.
