By the Regional Director, South Central Region, Enforcement Bureau:
1. In this Order ("Order"), we determine that no forfeiture penalty
should be imposed on RAMCO Broadband Services ("RAMCO").
2. In the Notice of Apparent Liability for Forfeiture ("NAL"), we found
RAMCO apparently liable for violating sections 17.4(g), 17.48,
17.51(a), and 17.57 of the Commission's rules ("Rules"). Consistent
with section 503(b)(4) of the Communications Act of 1934, as amended,
RAMCO was granted an opportunity to show, in writing, why no such
forfeiture should be imposed.
3. Upon review of the record and based upon additional information
provided by RAMCO, we are persuaded that RAMCO did not own the antenna
structure during the violations cited in the NAL and agree that no
forfeiture penalty should be imposed.
4. Accordingly, IT IS ORDERED that, pursuant to section 503(b) of the
Communications Act of 1934, as amended, and sections 0.111, 0.204,
0.311, 0.314 and 1.80 of the Rules, the proposed forfeiture issued to
RAMCO Broadband Services WILL NOT BE IMPOSED.
5. IT IS FURTHER ORDERED that a copy of this Order shall be sent by both
Certified Mail, Return Receipt Requested, and regular mail, to RAMCO
Broadband Services at 726 US Highway 202 Suite 320-119, Bridgewater,
NJ 08807-2737.
