ORDER
Adopted: February 13, 2009 Released: February 13, 2009
By the Chief, Enforcement Bureau:
1. In this Order, we modify, on our own motion, the Notices of Apparent
Liability for Forfeiture and Order (NAL/Orders) and Letters of Inquiry
issued in the above-captioned cases.
2. We modify those portions of the NAL/Orders that provide the
above-captioned parties thirty (30) days, from the release of the
NAL/Order, in which to either pay the full amount of the proposed
forfeiture or file a written statement seeking reduction or
cancellation of the proposed forfeiture. We hereby extend the date by
which such action must be taken to March 20, 2009.
3. We set aside those portions of the NAL/Orders that direct each of the
above-captioned parties to respond, within ten (10) days, to our
October 30, 2008 Letters of Inquiry. This action is without prejudice
to the right of the Bureau to re-issue such orders after further
evaluation and, additionally, to limit, modify, or expand its request
for information relative to these investigations.
4. We modify the portions of the Letters of Inquiry that require each
party to supplement, on a quarterly basis, the information provided in
the parties' responses to the Letters of Inquiry, and temporarily
suspend, until further notice, such obligations.
5. Accordingly, IT IS ORDERED that, pursuant to Sections 0.111, 0.311,
1.102 and 1.113 of the Commission's Rules, the Notices of Apparent
Liability for Forfeiture and Order and the Letters of Inquiry issued
in the above captioned proceedings ARE MODIFIED as set forth in
Paragraphs 1 - 4 above.
6. IT IS FURTHER ORDERED that a copy of this Order shall be sent by First
Class and Certified Mail, Return Receipt Requested, to each counsel of
record in the above captioned proceedings.
