FORFEITURE ORDER

By the Chief, Enforcement Bureau:
1. In this Forfeiture Order, we issue a $10,000
forfeiture to Richard I. Rowland, Longwood, Florida for
violating Section 301 of the Communications Act of 1934, as
amended (``Act'').1 In June and September of 2000, Mr.
Rowland operated an unlicensed FM radio station from
Longwood, Florida.
2. On October 12, 2000, the Field Office District
Director issued a $10,000 Notice of Apparent Liability
(``NAL'') to Mr. Rowland for apparently violating Section
301 of the Act.2
3. On November 13, 2000, Mr. Rowland submitted a
document to the Tampa Field Office. In it, he asserted that
the Field Office District Director must first register his
``Fiduciary Tax Estimate'' and ``Fiduciary Tax Return'' with
the State of Florida before he can attempt to prove any
financial liability against Mr. Rowland. We cannot
characterize anything in Mr. Rowland's document as being
responsive to the facts alleged in the NAL. Later that
month, on November 28, 2000, Mr. Rowland submitted a set of
documents to the Tampa Field Office. This time, Mr. Rowland
included, among other things, copies of state constitutions,
the Magna Carta, the Mayflower Compact, and his birth
certificate. Although he did not timely file his second set
of documents, our review of the documents revealed nothing
responsive to the facts alleged in the NAL. Additionally,
nothing in the documents persuades us to reduce the $10,000
forfeiture.
4. Accordingly, IT IS ORDERED THAT, pursuant to
Section 503(b) of the Act,3 and Sections 0.111, 0.311, and
1.80(f)(4) of the Commission's Rules (``Rules''),4 Mr.
Rowland IS LIABLE FOR A MONETARY FORFEITURE in the amount of
$10,000 for willfully and repeatedly violating Section 301
of the Act.
5. Payment of the forfeiture shall be made in the
manner provided for in Section 1.80 of the Rules,5 within 30
days of the release of this Forfeiture Order. If the
forfeiture is not paid within the period specified, the case
may be referred to the Department of Justice for collection
pursuant to Section 504(a) of the Act.6 Payment may be made
by mailing a check or similar instrument, payable to the
order of the ``Federal Communications Commission,'' to
