Washington, D.C. -- Today, the Federal Communications Commission (FCC) issued an order requiring a hearing in various 470-512 MHz Private Land Mobile licenses and applications in the names of DLB Enterprises, Inc., Metroplex Two-Way Radio Service, Ronald Brasher, Patricia Brasher, David Brasher aka D.L. Brasher, Carolyn Lutz, O.C. Brasher (deceased), Jim Sumpter, Norma Sumpter, Melissa Sumpter and Jennifer Hill. The Commission seeks to determine whether the licenses should be revoked, whether the applications should be granted, and whether forfeitures should be imposed on one or more of the parties.
An investigation by the Commission's staff revealed that Ronald and Patricia Brasher, with the assistance of David Brasher, Diane Brasher and Carolyn Lutz (collectively ``the Brashers'') may have submitted fraudulent applications to the Commission in the name of O.C. Brasher and Ruth Bearden, deceased relatives of the Brashers. The investigation also revealed that the Brashers may have filed applications and operated stations in the names of Jim Sumpter, Norma Sumpter, Melissa Sumpter, and Jennifer Hill. It appears that the Brashers' motive for filing such applications was to avoid limitations on the number of frequencies that one entity could apply for or control. The staff's investigation indicated that some of the parties may have misrepresented facts to, or lacked candor with, the Commission and abused the Commission's processes.
Accordingly, the Commission commenced a proceeding to determine the extent to which each licensee has violated the Commission's rules and to determine whether the named parties are qualified to remain or become Commission licensees. The proceeding will be heard by an FCC Administrative Law Judge, who will hold a hearing on the applications and licenses and issue an initial decision, which can then be appealed to the Commission.
