NOTICE OF VIOLATION

By the District Director, Los Angeles Office, Western Region, Enforcement
Bureau:
1. This is a Notice of Violation ("Notice") issued pursuant to Section
1.89 of the Commission's Rules, to Crown Castle GT Company LLC,
registrant of antenna structure # 1017908 in Bakersfield,
California.
2. On April 2, 2008, an agent of the Enforcement Bureau's Los Angeles
Office inspected antenna structure # 1017908 in Bakersfield,
California, and observed the following violation:
a. 47 C.F.R. S: 17.51(a): "All red obstruction lighting shall be
exhibited from sunset to sunrise unless otherwise specified." The
Antenna Structure Registration for antenna structure # 1017908
requires the tower to be painted and lit in accordance with FAA
Chapters 4, 8, and 12 of FAA Circular Number 70/7460-1K. Paragraph 81
of FAA Chapter 8 states that "[t]he light units should be installed
as specified in the appropriate portions of Chapters 4, 5, and 6. The
number of light levels needed may be obtained from Appendix 1." The
FCC's Antenna Structure Registration database lists the overall
height above ground as 57.3 meters for antenna structure # 1017908.
For structures of 350 feet AGL or less, paragraph 53(b)(1)(a) of FAA
Chapter 5 states that "[t]wo or more steady burning (L-810) lights
should be installed on diagonally or diametrically opposite
positions." Referring to Appendix 1, Fig 13, Red Obstruction
Lighting Standards (FAA Style A), the tower labeled A1 depicts
intermediate level lighting for towers between 46-107 meters. A
nighttime observation revealed that no intermediate lights were
displayed on antenna structure # 1017908.
3. Pursuant to Section 403 of the Communications Act of 1934, as amended,
and Section 1.89 of the Commission's Rules, Crown Castle GT Company
LLC, must submit a written statement concerning this matter within 20
days of release of this Notice. The response must fully explain each
violation, must contain a statement of the specific action(s) taken to
correct each violation and preclude recurrence, and should include a
time line for completion of pending corrective action(s). The response
must be complete in itself and signed by a principal or officer of
Crown Castle GT Company LLC. All replies and documentation sent in
response to this Notice should be marked with the File No. and NOV No.
specified above, and mailed to the following address:

4. This Notice shall be sent to by Certified Mail/Return Receipt
Requested and regular mail to Crown Castle GT Company LLC at the
address of record.
5. The Privacy Act of 1974 requires that we advise you that the
Commission will use all relevant material information before it,
including any information disclosed in your reply, to determine what,
if any, enforcement action is required to ensure compliance. Any false
statement made knowingly and willfully in reply to this Notice is
punishable by fine or imprisonment under Title 18 of the U.S. Code.
