                                                  Released: November 29, 2007

By the Anchorage Resident Agent Office, Anchorage, Alaska, Western Region,
   Enforcement Bureau:

    1. This is a Notice of Violation ("Notice") issued pursuant to Section
1.89 of the Commission's Rules, to Tanana Valley State Fair
Association, registered owner of antenna structure number 1005017,
located on College Road, Fairbanks, AK.

    2. On September 11, 2007, an agent of the Enforcement Bureau's Anchorage
Resident Agent Office performed a nighttime inspection of the tower
structure identified above. The agent observed the following

     a. 47 C.F.R. S: 17.21: "Antenna structures shall be painted and lighted
        when . . . [t]hey exceed 60.96 meters (200 feet) in height above
ground or they require special aeronautical study." The antenna
structure registration for antenna structure number 1005017 requires
that the structure comply with FCC paragraphs 1, 3, 12, and 21. FCC
Paragraph 12 states "[o]n levels at approximately two-thirds and
one-third of the over-all height of the tower, there shall be
installed at least two 116- or 125-watt lamps (A21/TS) enclosed in
aviation red obstruction light globes. Each light shall be mounted so
as to insure unobstructed visibility of at least one light at each
level from aircraft at any normal angle of approach." During the
inspection it was noted that the one-third level lighting was
extinguished and the two-third level lighting had only one of two
        side markers illuminated.

    3. Pursuant to Section 403 of the Communications Act of 1934, as amended,
and Section 1.89 of the Commission's Rules, Tanana Valley State Fair
