NOTICE OF VIOLATION
Released: October 19, 2007
By the District Director, Philadelphia Office, Northeast Region,
Enforcement Bureau:
1. This is a Notice of Violation ("Notice") issued pursuant to Section
1.89 of the Commission's Rules to Forever Broadcasting, LLC, licensee
of radio station WNTW in Somerset, Pennsylvania.
2. On September 26, 2007, an agent of the Commission's Philadelphia
Office took field strength measurements at the licensee's monitoring
points and observed the following violation:
47 C.F.R. S: 73.158(b): "When the description of the monitoring point as
shown on the station license is no longer correct due to road or building
construction or other changes, the licensee must prepare and file with the
FCC, in Washington, DC, a request for a corrected station license showing
the new monitoring point description. The request shall include the
information specified in paragraphs (a)(3) and (a)(4) of this section, and
a copy of the station's current license. A copy of the description is to
be posted with the existing station license." The descriptions for the
monitoring points should start at the known transmitter location and
proceed from one monitoring point to the next. The current monitoring
point descriptions had the following inaccuracies:
a. The description for the 287.5DEG monitoring point indicates in part
"proceed northeast on Coxes Creek 2.09 km to Sportsman's lake and
proceed left (west) 0.32 km to point." The description should specify
the street name, Sportsman Road, as the street on which to turn left
at Sportsman's Lake.
b. The description for the 342.5DEG monitoring point indicates in part
"From the intersection of Dean Hottle Farm and Enock-Stahls Road,
proceed right on Enock-Stahls 0.17 km to point just past trees." The
name of the road on which the monitoring point is located is no longer
Enock-Stahls Road; it has been renamed Casebeer Church Road (SR 4015).
3. Pursuant to Section 308(b) of the Communications Act of 1934, as
amended, and Section 1.89 of the Commission's Rules, Forever
Broadcasting, LLC, must submit a written statement concerning this
matter within twenty (20) days of release of this Notice. The response
must fully explain each violation, must contain a statement of the
specific action(s) taken to correct each violation and preclude
recurrence, and should include a time line for completion of pending
corrective action(s). The response must be complete in itself and
signed by a principal or officer of the licensee. All replies and
documentation sent in response to this Notice should be marked with
the File No. and NOV No. specified above, and mailed to the following
address:

4. This Notice shall be sent to Forever Broadcasting, LLC at its address
of record.
5. The Privacy Act of 1974 requires that we advise you that the
Commission will use all relevant material information before it,
including any information disclosed in your reply, to determine what,
if any, enforcement action is required to ensure compliance. Any false
statement made knowingly and willfully in reply to this Notice is
punishable by fine or imprisonment under Title 18 of the U.S. Code.
