NOTICE OF VIOLATION

By the District Director, Los Angeles Office, Western Region,
Enforcement Bureau:
1. This is a Notice of Violation ("Notice") issued
pursuant to Section 1.89 of the Commission's Rules,1 to
Timothy M.Valentine, licensee of amateur radio station
N6ZZA.
2. On July 26, 2005, agents of the Commission's Los
Angeles Office inspected radio station N6ZZA in Pacific
Palisades, CA, and observed the following violation(s):
2.a. 47 C.F.R. § 97.119(a) : ``Each amateur station,
except a space station or telecommand station,
must transmit its assigned call sign on its
transmitting channel at the end of each
communication, and at least every 10 minutes
during a communication, for the purpose of
clearly making the source of the transmissions
from the station known to those receiving the
transmissions. No station may transmit
unidentified communications or signals, or
transmit as the station call sign, any call
sign not authorized to the station.'' On July
26, 2005, between 9:30 a.m. and 12:30 p.m.,
Valentine failed to transmit his amateur radio
service call sign N6ZZA at the end of each
communication or every 10 minutes during his
communication on frequency 147.680 MHz.
2.b. 47 C.F.R. § 97.113(a): ``(3) No amateur station
shall transmit: Communications in which the
station licensee or control operator has a
pecuniary interest ....'' On July 26, 2005,
Valentine transmitted communications directly
related to his construction business.
3. Pursuant to Section 308(b) of the Communications Act of
1934, as amended,2 and Section 1.89 of the Commission's
Rules, Timothy M. Valentine must submit a written statement
concerning this matter within 20 days of release of this
Notice. The response must fully explain each violation,
must contain a statement of the specific action(s) taken to
correct each violation and preclude recurrence, and should
include a time line for completion of pending corrective
action(s). The response must be complete in itself and
signed by a principal or officer of the licensee. All
replies and documentation sent in response to this Notice
should be marked with the File No. and NOV No. specified
above, and mailed to the following address:

4. This Notice shall be sent to Timothy M. Valentine.
5. The Privacy Act of 19743 requires that we advise you
that the Commission will use all relevant material
information before it, including any information disclosed
in your reply, to determine what, if any, enforcement action
is required to ensure compliance. Any false statement made
knowingly and willfully in reply to this Notice is
punishable by fine or imprisonment under Title 18 of the
U.S. Code.4
