                       NOTICE OF VIOLATION

     1.  On April 22,  2004 and on May 6,  2004, an agent of  the 
Commission's San  Juan Office  investigated and  monitored  radio 
station WNZC494  located on  St. Croix,  USVI, and  observed  the 
following violation(s):

       1.a.  47 C.F.R.  1.903(a): Stations in the Wireless 
       Radio Services must be used and operated only in 
       accordance with the rules applicable to their 
       particular service as set forth in this title and 
       with a valid authorization granted by the Commission 
       under the provisions of this part, except as 
       specified in paragraph (b) of this section. Your 
       transmitters operating on 159.120, 161.415 and 
       161.570 MHz from Blue Mountain, St. Georges and the 
       Recovery Hill sites are not authorized to be in use 
       by the government of the Virgin Island's Public 
       Safety radio system on the island of St. Croix. 
       These transmitters were found to be operating in a 
       continuous test mode in conjunction with and in sync 
       with your authorized transmitter operating on 
       159.195 MHz from Recovery Hill, St. Croix.

     2.  Pursuant to Section  1.89 of the Commission's Rules,  47 
C.F.R.  1.89,  you must submit a written response to this Notice 
to the address in the letterhead within 15 days of the release of 
this Notice.  Include a statement of the specific action(s) taken 
to correct and  preclude recurrence  of each  violation.  If  you 
have not completed all corrective actions by the time your  reply 
is due, provide the date you will complete each action.  Mark all 
replies and documentation with the file number specified above.

     3.  Failure to respond to this Notice constitutes a separate 
violation that could  result in  additional penalties,  including 
monetary forfeiture.  Any  statement or  information you  provide 
may be used by the Commission to determine if further enforcement 
action is required.
