NOTICE OF VIOLATION

By the District Director, Boston Office, Enforcement Bureau:
1. This is a Notice of Violation ("Notice") issued
pursuant to Section 1.89 of the Commission's Rules,1 to
Hartcom, Inc., licensee of radio station WKND.
2. On July 23, 2003, an Agent of the Commission's Boston
Office inspected radio station WKND located at the above
address.
3. On August 7, 2003 a Letter of Inquiry, copy attached,
was sent to Hartcom, Inc. requesting a written reply to
issues raised during the inspection. Your written reply was
to have been sent to this office within 15 days from the
date of the letter.
4. No reply has been received as of today.
5. Hartcoms's apparent failure to respond to the Letter of
Inquiry evidences an apparent willful or repeated violation
of a Commission order.
Pursuant to Section 308(b) of the Communications Act of 1934, as
amended,2 and Section 1.89 of the Commission's Rules, Hartcom
Inc., must submit a written statement concerning this matter and
a complete response to the Letter of Inquiry dated August 7, 2003
within 15 days of release of this Notice. All replies and
documentation sent in response to this Notice should be marked
with the File No. and NOV No. specified above, and mailed to the
following address:

6. Your reply to the Letter of Inquiry must be supported
by a sworn statement, signed by a corporate officer or
member of the board of directors of Hartcom, Inc. attesting
to the truth and accuracy of the response.
7. This Notice shall be sent to Hartcom, Inc., Radio
Station WKND(AM), 544 Windsor Avenue, Windsor, Connecticut
06095.
8. The Privacy Act of 19743 requires that we advise you
that the Commission will use all relevant material
information before it, including any information disclosed
in your reply, to determine what, if any, enforcement action
is required to ensure compliance. Any false statement made
knowingly and willfully in reply to this Notice is
punishable by fine or imprisonment under Title 18 of the
U.S. Code.4
