Statement from FCC Chairman William E. Kennard
on Lutheran Church-Missouri Synod v. FCC
I am extremely disappointed that the D.C. Circuit denied our request for rehearing,
although I am heartened that four judges would have granted our rehearing petition. The
Commission's EEO rule has played a major role in ensuring that minorities and women can
fully participate in broadcasting, to the overall benefit of the American people. I remain
committed to furthering that critical public interest goal. While considering whether to seek
further review, I intend to present a proposal to the Commission in the near future to revise
our EEO rule in a way that will address the Court's concerns and ensure a level playing field
so that all Americans have the opportunity to participate in broadcasting.
