       PRESS STATEMENT OF CHAIRMAN WILLIAM E. KENNARD ON 
         C BLOCK FOURTH REPORT AND ORDER AND REAUCTION
     
     Completion of these auction rules brings us one step closer to the goal of getting returned
C block spectrum back into the marketplace.  I look forward to a productive reauction that
creates opportunities for small businesses.

     Since there are still licenses whose future remains uncertain, I again appeal to Congress to
enact legislation to clarify that licenses to use the public airwaves are not private property that can
be tied up in bankruptcy litigation.  Competition is not advanced when entities are permitted to
hoard licenses behind the shield of bankruptcy.
