STATEMENT OF FCC CHAIRMAN REED E. HUNDT REGARDING STAY OF C BLOCK AUCTION OCTOBER 19, 1995 Yesterday, the U.S. Court of Appeals for the Sixth Circuit stayed the auction of the Personal Communications Services entrepreneurs' block licenses. Tomorrow, we will ask the Court of Appeals to reconsider its action. We will request that the court lift the stay and allow this auction to go forward on schedule, beginning December 11, 1995. The stay resulted from Radiofone's challenge to the Commission's cellular-PCS cross- ownership rule, which limits cellular companies to 40 mhz of spectrum in their cellular service areas. Radiofone provides cellular services in a duopoly market. The cellular-PCS cross-ownership rule is intended to ensure there are at least five providers of broadband wireless communications service in each market. This rule guarantees competition. This auction has already been reviewed twice by the D.C. Circuit. Enough already. Billions of dollars of investment and hundreds of thousands of jobs depend on this auction occurring quickly. Radiofone's fears of competition are no basis for hurting our economy and delaying service to consumers. - FCC -
