ALLOCATION OF SPECTRUM BELOW 5 GHZ TRANSFERRED FROM FEDERAL GOVERNMENT USE. Granted in part and otherwise denied a petition for reconsideration of the Second Report and Order filed on September 8, 1995 by the Wireless Cable Association International (WCAI). Denied WCAI's request that all General Wireless Communications Service (GWCS) licenses be permitted to partition their service areas because the FCC intends to address this issue in another proceeding. Amended the Commission's Rules for GWCS to ensure consistency with current antenna structure marking and lighting requirements for other communciations services. Denied a request made by WCAI to license GWCS in Basic Trading Areas rather than Economic Areas. Denied in part and dismissed in part a petition for reconsideration of the First Report and Order filed on April 6, 1995 by the Association for Maximum Service Television, Inc. (MSTV) and several other organizations and a petition for reconsideration of the Second Report and Order filed on September 8,1995, by MSTV concerning the Commission's statutory authority with regards to GWCS. Consistent with the recently adopted Part 1 proceeding, decided to determine in a separate rulemaking whether Part 1 rules will aply to GWCS.
