CABLE SERVICES BUREAU PREEMPTS LOCAL RESTRICTIONS ON THE USE OF OVER-THE-AIR-RECEPTION DEVICES IMPOSED BY MEADE, KANSAS. Granted the petition for declaratory ruling filed by Star Lambert and Satellite Broadcasting and Communication Association of America (SBCA) concerning Meade, Kansas City Ordinance. The Order preempts provisions of Meade, Kansas ordinance that impair installation, maintenance or use of over-the-air reception devices (satellite dishes and other video reception antennas). The Order finds requirements for permit and prior approval violate the Commission's Over-the-Air Reception Devices Rule. The Order also finds unspecified setback requirements and unjustified $500 a day fine for violation of local ordinance to be unreasonable. Action by Bureau Chief. Adopted: July 22, 1997. by Order.
