The petitioners requested small system treatment pursuant to the Commission's Sixth Report and Order and Eleventh Order on Reconsideration reported at 10 FCC Rcd 7393(1995). Because petitioners share common affilation with Falcon Holding Group, L.P., the petitioners are each affiliated with an entity exceeding the numerical subscriber ceiling for small cable company treatment. ** CLOSED CAPTIONING OF VIDEO PROGRAMMING. Issued a NPRM seeking comment on proposed rules and implementation schedules to fulfill the statutory mandate of Section 713 of the Communications Act. Section 713, added to the Communications Act by the Telecommunications Act of 1996, requires the Commission to adopt rules for closed captioning by Auguest 8, 1997, to ensure that video programming is accessible to persons with hearing impairments.
