As part of each of their applications, Brentwood and Hauppauge  !Vrequest a waiver of these rules in order to permit them to use one frequency each for public safety  !purposes that are now allocated for highway maintenance operations: Brentwood seeks 47.20 MHz, and  S'Hauppauge seeks 47.16 MHz.  !Brentwood and Hauppauge have requested temporary assignment of 47.20 MHz and 47.16 MHz,  !respectively, in order to permit them to expand both of their current 46 MHz Fire Radio Service systems  !guntil they can migrate to the UHF band. Their migration is anticipated to be complete in approximately  !Zfour years. In the interim, both fire districts assert that they cannot maintain communications on their  S' !^current systems due to cochannel activity, and that all lowband Fire Radio Service channels in their area  !are in use. They note that the 47 MHz Highway Maintenance Radio Service frequencies in question are  !unassigned in the State of New York. Brentwood and Hauppauge each sought to coordinate the use of  !the frequencies through the American Association of State Highway and Transportation Officials  !g("AASHTO"), the frequency coordinator for the Highway Maintenance Radio Service, and through the  !ZInternational Municipal Signal Association and International Association of Fire Chiefs, Inc. ("IMSA"),  !the frequency coordinator for the Fire Radio Service. In both instances, AASHTO refused to coordinate  !the use of the frequencies, primarily citing Section 90.20(d)(21), which states that 47.16 MHz and 47.20  !MHz are to be assigned only in accordance with the 1990 47 MHz National Geographic Allocation Plan  !for Highway Maintenance Radio Services ("the 47 MHz Plan"). The 47 MHz Plan, which was approved  !by the Commission on January 18, 1991, provides that these frequencies cannot be used within the State  !of New York. (Under the 47 MHz Plan, the nearest states in which they may be used are Massachusetts  !pand Pennsylvania.) IMSA certified only those portions of their applications unrelated to the Waiver Requests.  !In addition, Hauppauge has attempted, through the submission of an electronic mail message, to have its  !DWaiver Request considered pursuant to Section 337(c) of the Communications Act of 1934, as amended,  S'' !47 U.S.C.  337(c). However, Hauppauge has not supplemented the message with a written request or  !the submission of additional record evidence in support of a Section 337(c) waiver request. Section 337(c)  !^states that the Commission shall grant an application by an entity seeking to provide public safety services  !to the extent necessary to permit the use of unassigned frequencies, if the Commission makes five specific  !findings: (1) no other spectrum allocated for public safety use is immediately available; (2) there will be  !no harmful interference to other spectrum users entitled to protection; (3) public safety use of theP+,,,M*e@d;[!,L\ '#k \ h  !*frequencies is consistent with other public safety spectrum allocations in the geographic area in question;  !Z(4) the unassigned frequencies were allocated for their present use not less than two years prior to the grant of the application at issue; and (5) the grant of the application is consistent with the public interest.
