Joint Request for Approval of Settlement, Grant of Phase II Unserved Area Application

     On October 16, 1996, Liberty Cellular, Inc. (Liberty), filed a Phase II Unserved Area Application
(application) (File Nos. 00367-CL-P2-97 and 00368-CL-P2-97) requesting authority to add a cell site in
Florence, Kansas, and to add directional antennas to existing cell sites in the Matfield Green and Eureka,
Kansas Metropolitan Statistical Areas (MSAs) (Market 435 B).  On December 19, 1996, Americomm I
Cellular (Americomm) filed an Informal Objection to Liberty's application.  Subsequently, on January 29,
1997, Liberty filed a Motion for Order to Show Cause and a Motion for Order to Cease and Desist that
objected to Americomm's license for station KNKR220 in the Wichita, Kansas MSA (Market 89 B-2) (File
No. 00550-CL-ML-97).  

     On December 31, 1997, Liberty and Americomm filed a Joint Request for Commission Approval of
Settlement, a Motion to Dismiss All Adverse Pleadings (Joint Request), and an assignment application for
Station KNKR220 from Americomm to Liberty in the Wichita, Kansas MSA (File No. 01076-CL-AL-98). 
The assignment application appeared on Public Notice, Report No. LB-98-22, on January 30, 1998.

     The Commercial Wireless Division (Division) has reviewed the parties Joint Request and finds that
it complies with section 22.129 of the Commission's rules, 47 C.F.R.  22.129.  Additionally, no petitions to
deny have been filed against the assignment application.  Accordingly, the Division dismisses all adverse
pleadings in this matter and finds that Liberty's application and the assignment application are in the public
interest.  Liberty's Phase II Application (File Nos. 00367-CL-P2-97 and 00368-CL-P2-97) for authority to add
a cell site in Florence, Kansas, and to add directional antennas to existing cell sites in Matfield Green and
Eureka, Kansas, and the assignment application for station KNKR220 (File Nos. 00550-CL-ML-97 and
01076-CL-AL-98) are hereby granted effective April 23, 1998.
