On December 9, 1997, the City of Revere, Massachusetts (Revere), filed a letter (Revere letter) opposing the November 19, 1997, grant of an authorization to ADF Communications, Inc. (ADF) to operate on frequencies 470/473.8625 MHz in the Boston, Massachusetts area. Public notice of the grant of ADF's application to operate Station WPLQ317 on the requested frequencies was given on November 25, 1997. By this Public Notice, we announce our treatment of the Revere letter as a petition for reconsideration of the November 19, 1997, action. By way of background, on September 11, 1997, Revere filed a request for Special Temporary Authority (STA) to operate on the same frequencies and in the same vicinity as those which were the subject of ADF's application granted on November 19, 1997. The Licensing and Technical Analysis Branch, Public Safety and Private Wireless Division of the Wireless Telecommunications Bureau (Bureau) granted the STA on September 19, 1997. Revere's STA is scheduled to expire on March 19, 1998. Revere currently employs these frequencies for public safety communications, including those related to emergency police operations. While we note that the Revere letter was not served on ADF, it nonetheless was submitted to the Commission within 30 days of the Public Notice announcing grant of ADF's application. In light of the public safety purposes for which the frequencies are being used under the September 19, 1997, STA, we believe that the public interest would be best served by waiver of Commission Rule 1.106(f), on our own motion, to treat the Revere letter as a petition for reconsideration under Section 1.106 of the Commission's Rules, 47 C.F.R.  1.106. As a result, we hereby direct Revere to serve a copy of the Revere letter on ADF and file proof of such service in accordance with Section 1.47(g) of the Commission's Rules within three business days of the date of release of this Public Notice.
