Underlying Purpose  S' e  11.` ` The Maritime Services provide for the unique distress, operational, and personal  Sh' xxcommunications needs of vessels at sea and on inland waterways.d2hB"c {OJ&'ԍMaritime Second Report and Order, 12 FCC Rcd at 16954.d They provide a vital emergency radio"h2,N(N(ZZ2"  S' xlink, similar to the terrestrial 911 system, to ensure safety of life and property in the marine environment.13"c {Oh'ԍId.1 In addition to serving a critical safety function, maritime radio is used for commercial operational  S' xVcommunications and general purpose communications.Z4Z"c {O'ԍMaritime Further Notice, 10 FCC Rcd at 5725.Z Such uses include ordering ships' stores,  xinquiring about berthing facilities, and changing schedules in short, providing a means of  S`'communication for the daytoday activities of a multibillion dollar industry.Q5`"c {O'ԍMaritime Notice, 7 FCC Rcd at 7863.Q  S' e  12.` ` MMR, a public coast station operator using HF and other frequencies, argues that HF  xxtelegraphyfacsimile frequencies are too scarce to be, in effect, reallocated for a land mobile radio service,  xMbecause existing maritime stations will need increased capacity to keep pace with the rise in the use of  S' xelectronic mail and other data transmissions.:6~"c yO'ԍMMR Petition at 2.: Globe Wireless agrees that these frequencies already are  Sp' xheavily used for the allocated purpose and should not be opened up to other uses at this time.O7p"c yO'ԍGlobe Wireless Informal Objection at 1.O TCI  xreplies that granting the waiver would actually increase the overall capacity available to ship stations, by  S ' x7adding another station providing maritime service.e8 "c yO^'ԍOpposition to Petition to Deny at 3; TCI Reply Comments at 2.e It also states that no new station will begin operating  xunless it is permitted to serve land units, because the maritime market alone is not sufficient to justify the  S ' xcosts of constructing and operating a new HF network.9 . "c yO'ԍOpposition to Petition to Deny at 2; Response to Informal Objection at 2; TCI Reply Comments at 2. SEA, Inc. disagrees with this conclusion, and  xadverts to the fact that the Commission recently authorized a new public coast station providing data  S ' x^transmission services to vessels at sea.m:Z "c {O' x ԍSEA, Inc. Comments at 2; see PinOak Communications, Inc., Order, 13 FCC Rcd 12802 (WTB PS&PWD  x 1998) (denying application for developmental license, and stating that the applicant would need a public coast station to provide the desired service, which the applicant later obtained).m We conclude that TCI has not established that application of the maritime rules in this case would frustrate or not serve their underlying purpose.  S'D IV. CONCLUSION ă  S' e   13.` ` We find that TCI has not met the requirements for obtaining a waiver of the Commission's  S' xRules. Specifically, it has not shown that granting the waiver would be in the public interest, nor has it  Sh' x7 shown that application of the rules in this case would frustrate or not serve the underlying purpose of the subject Part 80 Rules.  S'- V.
