The Notification was returned by the postal service as undeliverable and, consequently, CECO did not file an opposition. On December 8, 1994, counsel for Schafer requested expedited service on Schafer's  S'finder's preference request.   yOH'ЍLetter from A.B. On January 11, 1995, the Bureau's former Office of Operations awarded  S`'a dispositive preference to Schafer `x yOx 'Ѝ Letter from William H. Kellet, Counsel, Office of Operations, Wireless Telecommunications Bureau to Linda S. Schafer (dated Jan. 11, 1995) (Award of Dispositive Preference). and sent a notice of license cancellation to CECO by certified  S8'letter.8 yO 'ЍLetter from William H. Kellet, Counsel, Office of Operations, Wireless Telecommunications Bureau to CECO (dated Jan. 11, 1995) (Cancellation Letter).  S'5. On February 9, 1995, following the award of the dispositive preference to Schafer,  S'DBMLAXX(  yO'ЍDBMLA Corporation was a cochannel licensee on the same frequency as CECO (851.2857 MHz) in New Orleans, LA (Call Sign WPEU656). An assignment from DBMLA to DW Communications, Inc., occurred on July 2, 1997. DW is still listed in the Commission's database as the licensee for Station WPEU656.X, a cochannel licensee with CECO, filed a timely petition for reconsideration of the award.{H  yO'ЍDBMLA Petition for Reconsideration (filed Feb. 9, 1995) (DBMLA Petition).{  S'DBMLA stated that its license, on the channel in question, authorized a total of 71 mobiles yO'ЍWe note that the Commission's database reflects 70 mobiles licensed to DBMLA during the June, 1994, time period when Schafer filed her finder's preference request. , and that  Sp'consequently, the channel was not a proper subject for a finder's preference request.Np0 yO@'ЍDBMLA Petition at 12.N Subsequently,  SH 'on March 29, 1995, Schafer filed her application for authorization (FCC Form 600)FH  yO'ЍFCC File No. 500506.F for Station  S 'WSB467. On June 16, 1995, Schafer notified the Commission of a change of address. P yO 'ЍThis was the Commission's first indication that Schafer's address had changed from 3735 Baxter Avenue, Nashville, TN to 14200 Lebanon Road, Lot 205, Old Hickory, TN. The Office of Operations agreed with DBMLA's findings and, on March 6, 1997, granted the DBMLA Petition  S 'and set aside Schafer's dispositive award for Station WSB467.9X  yO$'ЍLetter from W. Riley Hollingsworth, Deputy Associate Bureau Chief, Office of Operations, Wireless Telecommunications Bureau to Steve Winters, DBMLA Corporation, and A.B. Cruz, Esq., Wiley, Rein & Fielding, Case No. 94F191 (dated Mar. 6, 1997) (Set Aside Letter). 9 On April 2, 1997, Schafer filed the petition for reconsideration that we are considering in this Order, seeking reinstatement of the finder's preference award for Station WSB467." ,>(>(ZZ "Ԍ S' I III. DISCUSSION ă  S'6. Schafer complains that she was not properly notified of the DBMLA Petition and only became aware of the pleading after the Commission sent out its March 6, 1997, Set Aside Letter. When the DBMLA Petition was filed with the Commission, it was accompanied by a certificate of service containing Schafer's address at 3735 Baxter Avenue. Although we agree that the postal service was unable to deliver the DBMLA Petition to Schafer, because she was no longer located at the 3735 Baxter Avenue address, we find, nevertheless, that Schafer received constructive notice of DBMLA's  S'Petition. {O( 'ЍSee 47 C.F.R.  1.47(f). Section 1.47(f) states that "service by mail is complete upon mailing." Id.Ħ Section 1.47(d) of the Commission's Rules provides that "documents may be served upon a party, his attorney, or other duly constituted agent by delivering a copy or by mailing a copy to the  Sp'last known address."IpZ yOj 'Ѝ47 C.F.R.  1.47(d).I Section 1.5 of the Commission's Rules specifies that the mailing address furnished by a licensee on its most recent application will be used by the Commission for official  S 'correspondence unless the licensee notifies the Commission to the contrary.E  yO'Ѝ47 C.F.R.  1.5.E As referenced above, the Commission was not apprised of Schafer's change of address until June 16, 1995. Therefore, on February 9, 1995, DBMLA properly served Schafer at her last known address of 3735 Baxter  S 'Avenue.R z {O'ЍSee supra para. 5 & n. 20.R  SX'7. Schafer also puts forth several arguments pertaining to DBMLA's qualifications as a licensee. She argues that the Commission was in error in granting DBMLA an authorization for frequency 851.2875 MHz, that DBMLA failed to construct, and that, therefore, DBMLA was, in fact,  S'not loaded to 70 mobile units.J  yO'ЍSchafer Petition at 12.J Based upon our review of the record and the Commission's database, we find these arguments to be unsubstantiated and without merit. DBMLA was properly coordinated and authorized as a new licensee on April 29, 1994. At the time of DBMLA's authorization, CECO  Sh'was the only other cochannel licensee within seventy miles of DBMLA's coordinates.h yO'Ѝ The Schafer Petition references the license of a Paul Stevens (Call Sign WPBV553), however, the Commission database reflects that Steven's coordinates places his Station at well over seventy miles (120.06 km) from DBMLA. Therefore, DBMLA would not have been required to coordinate with Stevens, nor would the  {O'number of mobiles licensed to Stevens have effected DBMLA's authorization. See Schafer Petition Attachments.  Since CECO was not loaded to 70 mobiles at the time DBMLA's application for authorization was filed, the channel  S'was available for assignment to other licensees.KN  yO$'Ѝ47 C.F.R.  90.633(b).K Furthermore, the Commission's database reflects a showing of construction from DBMLA on October 11, 1994. The database does reflect a lapse in service from July 22, 1997 to September 22, 1997, at which time DBMLA's license was reinstated. We, however, do not believe that this finding is relevant to the Schafer petition because the three",>(>(ZZ("ԫ S'month lapse in service was not permanent.R {Oh'ЍSee 47 C.F.R.  90.155.R Finally, as was referenced in the Set Aside Letter, DBMLA was indeed fully loaded to 70 mobiles at the time Schafer's request was filed. Therefore, we  S'conclude that Station WSB467 was never a proper subject of a finder's preference request.[Z {O'ЍSee supra para. 3 & n. 8.[ Accordingly, we affirm the set aside of the grant of Schafer's finder's preference request and deny Schafer's petition for reconsideration.  S8' Ã  S',IV. ORDERING CLAUSES ă  S'8. For the reasons discussed above, the set aside of the finder's preference award to Linda S. Schafer against Station WSB467 IS AFFIRMED.  SH '9.
