DISCUSSION  S'    S' 6.` ` Channel 8A.In its Petition, Plaincom argues that the March 25, 1996, amendment cured  xQthe application defect by eliminating the mutual exclusivity with Sauro's request for Channel 8A and asks  Sj' xthat we reinstate the application nunc pro tunc as of the original filing date.Aj~ yO 'ԍPlaincom Petition at 45.A Plaincom contends that the  S8' xamendment was an "amendmentofright" pursuant to former Section 101.29 of the Commission's Rules.a8 yO'ԍFormerly 47 C.F.R.  101.29; now 47 C.F.R.  1.927.a  xSpecifically, Plaincom contends that where the Commission has not returned a defective mutually  xexclusive application and the applicant cures the defect, post cutoff, then the amendment is effective upon  S ' xgfiling.J  {O'ԍSee Plaincom Petition at 5. J We disagree. Plaincom filed its original competing application on July 25, 1995, well after the  Sl ' xsixtyday cutoff period for filing mutually exclusive applications had lapsed.>l 0  yO<'ԍ47 C.F.R.  101.45.> A timely filed competing  xapplication is a prerequisite to the processing of an amendmentofright. Furthermore, "the listing of an  x@application on public notice as accepted for filing does not indicate that the application has been found  xby the Commission to be acceptable for filing and does not preclude the subsequent return of the  S ' xapplication."~  {O' xt ԍFormerly 47 C.F.R.  101.37(d); now 47 C.F.R.  1.933(b); see also McElroy Electronics Corp. v. FCC, 990  {O' x F.2d 1351, 1362 (D.C. Cir. 1993) (citing Cellular Applications for Unserved Areas in MSAs/NECMAs, Order, 4  xx FCC Rcd 3636, 3637, fn. 5 (1989)) (Held that the placement of "an application on public notice is not an indication  {O\' x that the application will be found acceptable for filing."); Digital Paging Systems of Philadelphia, Inc., Order, 2 FCC  xx Rcd 5320, 5321 (1987) (Held that "acceptance of an application for filing merely means that it has been the subject  xZ of preliminary review as to completeness." This action will not preclude "the subsequent . . . dismissal of the application if it is found to be defective."). Thus, because Plaincom's initial competing application was not timely filed, the amendment to that application is unacceptable for processing.  S' e 07.` ` Finally, Plaincom argues that the Commission's failure to process its application, in light  xof the amendmentofright, violates Congress's directive to the Commission to "continue to use engineering  xsolutions, negotiation, threshold qualifications, service regulations and other means in order to avoid  Sn' xmutual exclusivity in applications and licensing proceedings."^n yO&'ԍ47 U.S.C.  309(j)(6)(E); Plaincom Petition at 34.^ We believe that this directive, at a  x<minimum, pertains to applications that meet Commission filing requirements. As discussed above,";,l(l(,,"  xtPlaincom's initial competing application was filed after the sixtyday cutoff period had lapsed and was  x<dismissed as defective. Consequently, we conclude that no mutual exclusivity exists as to Sauro's  xVapplication for Channel 8A, and thus, we believe that the provisions of Section 309(j)(6)(E) of the  x Communications Act do not require a different result under these circumstances. As a result, for the  xaforementioned reasons, Plaincom's Petition requesting reinstatement of its application is denied as to Channel 8A.  S' s8.` ` Channel 8B.The Sauro application, as discussed above, requested two half pairs  x(Channel 7A and Channel 8A) rather than a complete channel pair. We find that Plaincom's request for  xZChannel 8B in West Palm BeachBoca Raton, FL is not mutually exclusive with the Sauro application.  x7Therefore, we reinstate the portion of Plaincom's application concerning authorization for Channel 8B as  xkof its original filing date of July 25, 1995, and direct the Branch to further review and process this portion  S ' xkof Plaincom's application consistent with the Commission's decisions in the Report and Order and Second  Qk 'NPRM.
