In another case, Paramount Stations Group of Fort Worth/Dallas, Inc. (KXTA(TV)), 13 X4 xcFCC Rcd 23480 (MMB 1998) (Paramount Stations), a $12,500 forfeiture was assessed for 12 xoverages, including five programlength commercials, which occurred over a two year period. X!4 xCompared to these cases, station WFXT(TV) had fewer total overages, but more programlength X"4 xcommercials. However, the violations in TMG of Memphis, Paramount Stations and the instant xZcase occurred over an extended period of at least two years. In addition, the licensee in each case X$4 x[offered virtually the same explanations for their respective overages and claimed to have xhestablished policies and procedures to prevent future violations of the children's television xcommercial limits. Based on these considerations, we find the violations in the instant case, on XI'4 xMbalance, comparable to those in TMG of Memphis and Paramount Stations, and conclude that an"I',))qq%" appropriate, comparable forfeiture is $12,500. xYou are afforded a period of 30 days from the date of this letter "to show, in writing, why a xEforfeiture penalty should not be imposed or should be reduced, or to pay the forfeiture.
