In a similar  Y!4 xucase, Max Television of TriCities, L.P. (WEMT(TV)) , 12 FCC Rcd 11988 (MMB 1997) (Max  Y"4 xyTelevision), a $10,000 forfeiture was assessed for 30 violations which occurred over a tenmonth  Y#4 x<period . Of those overages, ten were between 10 and 30 seconds in duration, two were between  xone minute in duration, one was one minute and ten seconds in duration, three were one minute  xyand 30 seconds in duration, four were two minutes in duration, four were two minutes and 30  xseconds in duration, two were three minutes in duration, three were three minutes and 30  xseconds in duration and one was a programlength commercial. The licensee in that case  xattributed the overages to human error and asserted that it had implemented policies and"-(,))qq%"  Y4 xprocedures to prevent further violations. Compared to station WEMT(TV) in Max Television,  xpstation KLSRTV reported two fewer total violations, but one more programlength commercial.  Y4 xdHowever, in both cases, the conventional overages were of significant durations and the  xcviolations at each station occurred over approximately the same period of time. In addition, both  xqlicensees offered the same reasons for their violations and claimed to have implemented  xcorrective measures to prevent future violations. Based on these considerations, we find the  Yx4 xviolations in the instant case, on balance, comparable to those in Max Television. Therefore,  Yc4we conclude that an appropriate, comparable forfeiture is in the amount of $10,000.  YM4  xYou are afforded a period of 30 days from the date of this letter "to show, in writing, why a  x+forfeiture penalty should not be imposed or should be reduced, or to pay the forfeiture. Any  xshowing as to why the forfeiture should not be imposed or should be reduced shall include a  xdetailed factual statement and such documentation and affidavits as may be pertinent."  xFSection 1.80(f)(3) of the Commission's Rules, 47 C.F.R.  1.80(f)(3). Therefore,  xthe license renewal application of California Oregon Broadcasting, Inc., for station KLSRTV  xEugene, Oregon, (File No. BRCT981001KR), IS HEREBY GRANTED, subject to the  xlcondition that, on December 31, 2006, or by such other date as the Commission may establish  x+in the future under Section 309(j)(14)(A) and (B) of the Communications Act, the licensee shall  xsurrender either its analog or its digital television channel for reallocation or reassignment  xpursuant to Commission regulations.
