At the request of West Wind Broadcasting ("petitioner"), the Commission has before it the Notice of Proposed Rule Making, 12 FCC Rcd 13225 (1997), proposing the allotment of Channel 290A to Patterson, Iowa, as the community first local aural transmission service. Petitioner filed comments restating its interest in applying for Channel 290A, if allotted. No other comments were received. 2. In the Notice, petitioner was requested to furnish sufficient information to support a finding that Patterson was a community for allotment purposes. In response, petitioner submits that Patterson has an organized government with Mr. Len Cutter as the community's current mayor. The community has its own town hall, post office, zip code, private grain elevator, a fish and tackle store which also serves as the community grocery store. Petitioner notes the presence of one church which incorporates Patterson in its name. Petitioner describes Patterson as a small community which has an agricultural based economy. 3. Based upon petitioner's showing and the fact that Patterson is an incorporated community, we find it to be a community for allotment purposes. Channel 290A can be allotted to Patterson in compliance with the Commission's minimum distance separation requirements without the imposition of a site restriction. 4. Accordingly, pursuant to the authority contained in Sections 4(i),5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective April 13, 1998, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Patterson, Iowa 290A 5. A filing window for Channel 290A at Patterson, Iowa, will not be opened at this time. Instead, the issue of opening a filing window for this channel will addressed by the Commission in a subsequent order. 6. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 7.
