At the request of Charles D. Hall ("petitioner"), the Commission has before it the Notice of Proposed Rule Making, 12 FCC Rcd 17502 (1997), proposing the allotment of Channel 257C2 to Monroe, Utah. Petitioner filed comments restating his interest in applying for Channel 257C2, if allotted to the community. No other comments were received. 2. We believe the public interest would be served by allotting Channel 257C2 to Monroe, Utah, since it will provide the community with its first local aural transmission service. As stated in the Notice, Channel 257C2 can be allotted to Monroe in compliance with the Commission's minimum distance separation requirements with a site restriction of 1.3 kilometers (0.8 miles) south of the community in order to avoid a short-spacing conflict to vacant Channel 256A at Levan, Utah. 3. Accordingly, pursuant to the authority contained in Sections 4(i),5(c)(1), 303(g) and (r) and 307(b) of the Communications Act of 1934, as amended, and Sections 0.61, 0.204(b) and 0.283 of the Commission's Rules, IT IS ORDERED, That effective March 30, 1998, the FM Table of Allotments, Section 73.202(b) of the Commission's Rules, IS AMENDED, with respect to the community listed below, to read as follows: City Channel No. Monroe, Utah 257C2 4. A filing window for Channel 257C2 at Monroe, Utah, will not be opened at this time. Instead, the issue of opening a filing window for this channel will be addressed by the Commission in a subsequent order. 5. IT IS FURTHER ORDERED, That this proceeding IS TERMINATED. 6.
