This is an unofficial announcement of Commission action. Release of the full text of a Commission order constitutes official action. See MCI v. FCC. 515 F 2d 385 (D.C. Circ 1974).

Report No. MM 98-13 MASS MEDIA ACTION September 29, 1998

COMMISSION SUSPENDS REQUIREMENT FOR FILING OF EEO FORMS

The Commission adopted an Order effective today suspending until further notice the requirement that television and radio broadcast licensees and permittees submit Broadcast Station Annual Employment Reports (FCC Form 395-B), and Broadcast Equal Employment Opportunity Program Reports (Form 396), and Broadcast EEO Model Program Reports (396- A). The Commission stated that in view of the denial by the U.S. Court of Appeals for the D.C. Circuit of the Commission's request for rehearing of Lutheran Church - Missouri Synod v. FCC, this action is advisable while the Commission considers adoption of new EEO rules that address concerns of the Court.

Because the Lutheran Church decision involves broadcasters only, all other services remain unaffected and must continue to file their reports with the Commission. For additional information, interested parties may contact the EEO Branch of the Commission's Mass Media Bureau at (202) 418-1450.

Action by the Commission September 29, 1998, by Order (FCC 98-250). Chairman Kennard, Commissioners Ness, Powell and Tristani with Commissioner Furchtgott-Roth concurring and Chairman Kennard and Commissioner Furchtgott-Roth issuing statements.
