Dear Mr. Shea:

In a letter dated July 27, 1994 you complained about tower construction by GB Broadcasting Company ("GB"), permittee of a new broadcast station (WBGV) for Marlette, MI. You state that GB purchased residential/agricultural property instead of commercial property for its tower structure, in proximity to local residences and in violation of local zoning regulations. You also indicate that GB has stated that there is no other possible location for the proposed tower.

Many factors are involved when an applicant selects a particular site for a radio or television station. These include the Commission's requirement for a minimum signal strength to be placed over the community of license (for FM stations, 70 dBu), adherence to the Commission's multiple station ownership rules, the effects of local terrain on a station's signal, protection of other stations from interference, and Federal Aviation Administration approval to insure airspace safety. Other factors not regulated by the Commission but of prime importance to the applicant include local zoning and land use regulations, whether a particular site is available for lease or sale and the cost of such a site, available utilities, and ease of access to that site. Thus, the Commission cannot specify a particular location for a station; rather, the Commission relies on the applicant for a radio or television station to weigh the various factors and select the best possible site from the applicant's perspective, consistent with the Commission's regulations.

Given these factors, and on the basis of the information provided in WBGV's granted construction permit application BPH-910628MB and in your letter, it is not possible for the Commission to state that other areas are or are not available to which WBGV could potentially be located. It appears that the current controversy over whether to allow construction of WBGV's tower will have to be decided at the local level by those with expertise in the local zoning regulations.
