The agent properly identified  xhimself as a representative of the FCC, showed Mr. Farlow his official badge, and asked to inspect Mr.  xFarlows CB radio station. Mr. Farlow then led the agent to his back door where he hesitated and then  xasked the agent for a search warrant. The agent explained to Mr. Farlow that both  303(n), and 95.426  x\(CB Rule 26), authorize inspection of all CB radio stations by the FCC and a search warrant was not  xnecessary. Nevertheless, Mr. Farlow refused to allow the agent entry to his residence in order to inspect  xthe station. After observing a CB radio in the truck parked in the driveway at 103 Browning Drive,  x=Thomasville, North Carolina, the agent also requested that he be allowed access to inspect Mr. Farlows  xmobile CB radio station. Mr. Farlow again refused to allow the agent to inspect his CB station.  xNSubsequent to the request for inspection, the Bureaus Norfolk Office issued the subject NAL on November 18, 1998, for the willful violations of  303(n) and 95.426 (CB Rule 26). R X` hp x (#%'0*,.8135@8:+.d,d,v/"  xof the interference. Furthermore, Mr. Farlow states that, at the time of the attempted inspection, he no  xlonger had the CB equipment at his residence because of all the complaints from his neighbors. Mr.  xFarlow's response to the NAL further contends that he was unable to let the agent into his house as his  xwife was indisposed. Mr. Farlow also claims that the agent did not have a search warrant, and that the  xkagent would not allow him the time to call his attorney. Furthermore, Mr. Farlow asserts that he had  x.recently been threatened by neighbors and felt uncomfortable allowing a total stranger [who] shows up  xafter business hours in a used faded Explorer without any recognizable law enforcement, no search  xwarrant, no previous paperwork or anything to explain my rights. Finally, Mr. Farlow states that he did  xnot know who the FCC was, nor did he know the rules and regulations associated with operating a CB radio station.  r&WW   S-( DISCUSSION  S -  Si - ` x5.` ` #&G\  P_x&P#The Bureaus Norfolk Office issued the forfeiture pursuant to  503 and 1.80. In  x[assessing the forfeiture amount, the Norfolk Office followed the forfeiture standards established in #&G\  P`x&P# 503  S - x0and #&G\  Pax&P#The Commission's Forfeiture Policy Statement and Amendment of Section 1.80 of the Rules to  S - xIncorporate Guidelines, 12 FCC Rcd 17087 (1997), recon. pending  ("Policy Statement").#&G\  Pbx&P# It is required  xby  503(b) that the Commission take into account the nature, circumstances, extent and gravity of the  xviolation and, with respect to the violator, the degree of culpability, any history of prior offenses, ability  S9-to pay, and other such matters as justice may require. See, 47 U.S.C.  503(b)(2)(D).#&I7  PTcQx&P#xx  S- ` x6.` ` We have reviewed Mr. Farlows arguments concerning the events of September 8, 1998,  xand we find that none of them are sufficient to eliminate the liability associated with the noted violations.  x>We believe that if Mr. Farlow no longer had CB radio equipment in his residence that he should have  xstated so at the time of the request for inspection. He did not. In fact, a neighbor of Mr. Farlows had  xidentified Mr. Farlows voice in a transmission that caused interference to her home electronic equipment  xjonly a few days prior to the inspection. Additionally, a neighbor observed Mr. Farlow removing the CB  x{radio equipment from his residence on September 9, 1998, the day after the attempted inspection.  x.Moreover, the FCC agent visually observed that a mobile CB radio station was present in Mr. Farlows  xktruck on September 8, 1998. Mr. Farlow does not offer an explanation as to why he denied the agent  xentry to inspect his truck. Mr. Farlow does not offer any mitigating circumstances which would excuse  xLhis refusal to allow inspection of his CB radio station. The hour of the attempted inspection, 6:30 p.m.,  xwas during daylight hours, and the agent presented legitimate FCC identification credentials, which according to the agent, was acknowledged by Mr. Farlow as being official.  S - ` x7.` ` Under  303(n) the FCC has the authority to inspect all radio installations associated with  xstations required to be licensed by any Act, or which the Commission by rule has authorized to operate  xwithout a license under Section 307(e)(1). 47 U.S.C.  303(n). This definition expressly includes CB  xradio stations as those that the FCC is authorized to inspect. Likewise, under  95.426, [i]f an authorized  xFCC representative requests to inspect your CB station, you must make your CB station and records  xavailable for inspection. 47 C.F.R.  95.426(a). Thus, an FCC agent does not need a search warrant to  S - x=inspect a radio station. See Norfolk Southern Railway Company, 11 FCC Rcd 519 (CIB 1996) (the right  x?to inspect a station is one of the cornerstones of the FCCs ability to ensure compliance with the  xCommunications Act and the Commissions Rules). Pursuant to 47 C.F.R.  95.402(a)(1), Mr. Farlow,  x[as a CB operator, had the responsibility to be familiar with the CB rules and to comply with these rules.  x The Commission expects its licensees (including CB users authorized by CB Rule 4, 47 C.F.R.  95.404,  xto operate without an individual station authorization) to be familiar with those rules that govern the class  x]of station they operate. Claims of unfamiliarity with rules cannot be used to justify mitigation of  St&- xpenalties. William J. McCray, Jr., 9 FCC Rcd 1897 (FOB 1994). As such, the violations of  303(n)"t&.**0*"  S-and  95.426 were willful.F" Sh-  " 1. 1. 1. a.(1)(a) i) a) 1. 1. 1. a.(1)(a) i) a)Ѝ#A\  PfP#xSection 312(f)(1) of the Communications Act of 1934, as amended, 47 U.S.C.  312(f)(1), which also  xapplies to  503(b), provides: "[t]he term 'willful,' when used with reference to the commission or omission of any  xact, means the conscious and deliberate commission or omission of such act, irrespective of any intent to violate any  xprovision of this Act or any rule or regulation of the Commission authorized by this Act or by a treaty ratified by  {O-the United States." See Southern California Broadcasting Co., 6 FCC Rcd 4387 (1991).#B7  PTgQP#Ѹ  S- ` nx8.` ` In sum, we have examined Mr. Farlows response in conjunction with the Policy Statement  Sh- xand the above statutory factors and conclude that Mr. Farlow has failed to provide a sufficient justification for reducing the forfeiture amount. We therefore affirm the forfeiture amount of $7,000.  S- ` @x9.` ` ACCORDINGLY, IT IS ORDERED that, pursuant to 47 U.S.C.  503(b), 47 C.F.R.   S- x1.80, and the Policy Statement, 12 FCC Rcd 17087, James R. Farlow IS LIABLE FOR A MONETARY  Sj- xFORFEITURE in the amount of $7,000 for willful violation of 47 U.S.C.  303(n) and 47 C.F.R. 95.426 (CB Rule 26).
