DISCUSSION TP  X"- A.xTariff Filing Dates and Procedures x2. Incumbent vLECs are permitted by section 61.58(d) of the Commission's rules to  X-make their tariff filings 15 days prior to the effective date of their tariffs.BFE? yO'-ԍ 47 C.F.R.  61.58(d).B If a filing is not made pursuant to section 61.58(d), it must comply with section 61.58(c)(5), which requires" 0*0*0*"  X-not less than 45 days' notice.E< yOy-ԍ 47 C.F.R.  61.58(c)(5).E Tariff filings can only be made on days the Commission is officially open for business. U S WEST requests special permission to make either a 17day or a 14day filing with an effective date of February 1, 1999. Because February 1 is a Monday, and a 15day filing is precluded because the Commission is not officially open for  X-business on Sunday, January 17,JX< yO-ԍ U S WEST Application at 1.J we grant U S WEST's request for special permission to waive the requirements of section 61.58(c)(5) to make a tariff filing on 17 days' notice with an effective date of February 1, 1999. The 17day tariff filing will allow interested parties and the Commission staff sufficient time to review the tariffs. The tariffs, therefore, should be filed no later than Friday, January 15, 1999. Any incumbent LEC that intends to implement a number portability enduser surcharge to be effective on February 1, 1999 may also file on 17 days' notice without requesting special permission for a waiver of section  X -61.58. < yO- xԍ Incumbent LECs that elect to file tariffs with an effective date after February 1, 1999 may, of course, file a 15day filing pursuant to Section 61.58(d) of the Commission's rules.
