Part 69 defines  x"telephone company" as an incumbent local exchange carrier ("incumbent LEC") as defined in  X4 x}section 251(h) of the Communications Act of 1934 ("Act").IZ% yO'ԍ47 C.F.R.  69.2(hh).I Furthermore, section 69.601 of the  xCommission's rules, that governs the participation of telephone companies in NECA, only applies  xto incumbent LECs. X 4 e 4.` ` When the Commission revised section 69.2 to require that telephone companies  X 4 xbe incumbent LECs to participate in NECA tariffs and pools, the Commission did not specifically  xprovide for companies that do not meet the definition of incumbent LEC, that come into existence  xafter the enactment of the 1996 Act and that serve previously unserved areas. To the extent  x}necessary, therefore, we waive the incumbent LEC requirement of Part 69 of the Commission's  x rules for Wilderness Valley. This waiver permits Wilderness Valley to participate in NECA pools  xand tariffs and to become a member of NECA, but does not affect Wilderness Valley's  XK4obligations under section 251.K|% yOx'ԍWe note that as a rural telephone company, Wilderness Valley is exempt from the interconnection  {O@'requirements in section 251(c) until the company receives a bona fide request for interconnection, services, or network elements, and the Minnesota Public Utility Commission determines that such request is not unduly  {O'economically burdensome, is technically feasible, and is consistent with section 254 of the Act.
