The Commission also delegated authority to act on petitions to modify LATA boundaries  {O- xxto the Common Carrier Bureau. Id. at para 23. On August 6, 1997, the Commission released a decision granting  xJrequests to modify LATA boundaries to permit three independent telephone company (ITC) exchanges in Texas to  xchange LATA association for purposes of improving service to subscribers. The Commission stated that a carrier  xwill be deemed to have made a prima facie case supporting grant of a proposed association change if the petition:  x(1) states that the association change is necessary because of planned upgrades to the ITC's network or service that  x<will require routing traffic through a different BOC LATA; (2) involves a limited number of access lines; and (3)  xincludes a statement from the affected BOC(s) requesting a LATA modification, pursuant to section 3(25) of the Act,  x to permit the change in association. X - x` `  hhIII. DISCUSSION  X- `  x5.` ` USW's petition proposes to establish twoway ELCS between OCSA and the  xlYutan exchange. USW would provide oneway service from OCSA to Yutan, and Aliant  X - x-Communications (Aliant) would provide oneway service from Yutan to OCSA.C 0 ~ yO`-ԍxUSW Petition at 2.C USW currently  xprovides service to customers in the OCSA, and, as proposed in the petition, callers making calls  x=from OCSA to Yutan would do so under a flatrated, nonoptional ELCS plan. Aliant currently  xprovides service to customers in the Yutan exchange, and, as proposed in the petition, callers  xmaking calls from Yutan to OCSA would pay a flatrated monthly service charge. In addition  xto the flatrated monthly service charge, Aliant customers placing calls outside their standard local  xycalling area, but within a 25mile radius (which includes OCSA), would be charged a perminute  X- xfee.: ~ {O-ԍxId.: In lieu of the perminute fee, customers may choose 60 minutes of calls for a flatmonthly  Xg-rate; after 60 minutes, the customer is charged a perminute fee.BgR ~ {Oj-ԍxId. at 23.B  X!- ` x6.` ` USW's petition is accompanied by: (1) an order confirming state approval of the  xlimited LATA modification requested; (2) a statement that USW will only provide traditional  xlocal service; (3) a community of interest finding by the Nebraska Public Service Commission;  x(4) usage data; and (5) a statement that OCSA has 329,669 access lines, and Yutan has 700  xLaccess lines. The usage data does not include traffic between OCSA and Yutan because such  xtraffic is presently interLATA. Aliant, however, reported that 86% of its customers make two"r,l(l(,,R"  X- xor more calls to OCSA, and that each account averages 32 calls per month.~ {Oy-ԍxThe petition states that over 22,000 calls per month are made from Yutan to OCSA. Id. at 5, 9. The brief  X- xdescriptions of the basis for the requested ELCS reveal that the area's economic development is  x[retarded due to the current local calling arrangements, and that making interLATA toll calls for such services generates significant expenses for residents and retards economic development.  XQ- ` x7.` ` As we stated in the July 1997 Order, granting an ELCS petition removes the  X0- xjproposed route from the competitive interexchange market.S0Z~ {O; -ԍxJuly 1997 Order at para. 18.S Some LATA modifications could  x-reduce the incentive created by Section 271 of the Act for BOCs to open their local exchange and  X- xexchange access markets to competition.:~ {O -ԍxId.: While the number of access lines in the OCSA is  x<large, the number of lines in the Yutan exchange is not so large as to raise concerns about USW's  x\willingness to open its local markets to competition. Additionally, although Aliant plans to  xprovide service to OCSA through an optional plan, and the District Court refused to grant waivers  X^ - xyfor optional or measuredrate plans,_^ ~~ {O-ԍxSee July 1997 Order at paras. 89._ the District Court's prohibition was aimed at BOCs rather  xthan other LECs. Accordingly, given the small number of access lines involved in the Yutan  X - xyexchange as well as the type of service to be offered by USW (i.e., flatrated, nonoptional), we  xLfind that the proposed LATA modification will not have a significant anticompetitive effect on  xthe interexchange market or on USW's incentive to open its local exchange and exchange access markets to competition.  Xk- IV. CONCLUSION TP  X%- ` x8.` ` We conclude that, as shown in USW's petition, the community's need for the  xproposed ELCS routes outweighs the risk of potential anticompetitive effects. Granting USW's  xpetition serves the public interest by permitting a minor LATA modification in a case where such  x-modification is necessary to meet the needs of local subscribers and will not have any significant  xeffect on competition. Accordingly, we approve USW's petition for limited LATA modification.  xThe LATA is modified solely for the limited purpose of allowing twoway local calling service  xbetween the specific exchanges or geographic areas identified in the requests. The LATA is not  xmodified to permit the BOC to offer any other type of service, including calls that originate or  x/terminate outside the specified areas.
