On April 2, 1998,  S!' xZCentury filed a Petition for Revocation of that certification, which the San Buenaventura Order denied  xxon the grounds that Century failed to satisfy the competing provider test set forth in Section 76.906 of the""z,))ZZ!"  S' xCommission's rules and therefore is not subject to effective competition.\= xPh' xp ԍThe competing provider test, one of three tests set forth in Section 623, examines whether the franchise area  x+ is (1) served by at least two unaffiliated multichannel video programming distributors each of which offers  x comparable programming to at least 50 percent of the households in the franchise area; and 2) the number of  x households subscribing to multichannel video programming other than the largest multichannel video programming  zP' x distributor exceeds 15 percent of the households in the franchise area. See 47 C.F.R.  76.905(b)(2). See also 47 C.F.R.  76.910(b)(4). The City implemented its rate  xauthority certification by adopting rate orders requiring Century to reduce its basic service tier rates, make  S' xcertain adjustments to its equipment and installation rates, and make refunds to subscribers.B\= zP ' x ԍSee Order Nos. 981 and 982 of the City Council of San Buenaventura, California, dated April 2, 1998 and September 29, 1998, respectively. Century's  xrevocation petition amounts to an attack on the City's authority to adopt those rate orders. Century also  xfiled petitions for stay and review of the City's rate orders. This order addresses only Century's petition  S8'for reconsideration of the San Buenaventura Order.  S' e 3.` ` In Implementation of Sections of the Cable Television Consumer Protection and  S' xCompetition Act of 1992, First Order On Reconsideration,c\= zP'ԍ9 FCC Rcd 1164, 1181 (1994) ("First Order on Recon").c the Commission construed the effective  xtcompetition provisions set forth in Section 623 as requiring that effective competition be demonstrated  xon the basis of a franchise area, which is defined as the area a cable operator is authorized to serve in its  SN ' xfranchise.[N . \= zP'ԍSee 47 U.S.C.  541(a)(3) & 541(a)(4).[ The Commission stated that a more restricted definition of a franchise area may be appropriate in some circumstances:  SXAn affirmative decision by a system operator to restrict service logically redefines its  franchise area in terms of the objectives of this provision. Accordingly, we will permit  franchise authorities to demonstrate the boundaries of such a redefined franchise area.  Such a showing, however, will be limited to situations in which a system operator has  ~itself, through its own conduct, self-defined the areas to be served to such an extent that  this redefined area accurately portrays the operator's "franchise area." The fact that a  franchise area has not as yet been filled out by construction of a system would not by  S'itself be taken as redefining the service area.V \= zP'ԍFirst Order on Recon, 9 FCC Rcd at 1180.V   SF' e 4.` ` The San Buenaventura Order examined the existence of effective competition in Century's  xfranchise area by comparing cable system service area maps filed with the City by Century and by another  xcable operator, Avenue TV Cable Services, Inc., as part of the franchise renewal process in 1983, with  S' xmaps filed with the City in 1998. Citing the Commission's decisions in Valley Center R \= zP%'ԍValley Center Cable Systems, L.P., 10 FCC RCD 11940 (1995) ("Valley Center"). and Daniels,[ ^ zP' xm ԍDaniels Cablesystems,Inc., d/b/a North County Cablevision, L.P., 12 FCC Rcd 17410 (CSB 1997)  zPZ' x ("Daniels"). See also Florida Cablevision Management, Corp. d/b/a Cablevision Industries, 11 FCC Rcd 6876 (CSB  zP$'1996). [" ,-(-(ZZ1"  S' xCentury had argued that the absence of any expansion of its cable system into the portion of San  xDBuenaventura served by Avenue is not relevant in determining whether effective competition exists in San  S' xBuenaventura. The Order disagreed, noting that "[t]he important difference between the two cases,  S' x*however, is that in Daniels the cable operator, while not expanding into its competitor's service area, did,  x^in fact, submit evidence demonstrating that it had substantially expanded its cable system and service area  xsince receiving its franchise. In the instant proceeding, Century has submitted no evidence that it continues  S' xgto expand its service area or that it has not affirmatively redefined its franchise area. . . ."n \= zP 'ԍSan Buenaventura Order, 13 FCC Rcd at 24163 (footnotes omitted).n The Order  xfound that Century's current subscribers were located in portions of the franchise area not served by  xAvenue, and that Century had not expanded its service area since 1983. Based on those findings, the  S' x*Order concluded that Century had not shown any intention to fill out its franchise area, and that Century,  x7through such conduct, had self-defined its franchise area to include only the portion of the franchise area  x7not served by Avenue and held that Century was not subject to effective competition within the redefined  S( 'franchise area.1 ( \= zPH'ԍId.1  S ' III.DISCUSSION AND ANALYSIS  S ' e 5. ` ` The Petition for Reconsideration presents information showing that Century has  xconstructed more than 26 miles of cable plant extensions in San Buenaventura, passing 2,067 additional  S8' xchomes and providing service to 1,333 additional subscribers since 1990. 8\= xP' x ԍWe reject the City's objection to the receipt of this information as untimely presented. Although it had the  x burden of establishing that Century had redefined its franchise area, the City failed to present any evidence that  x} Century had not undertaken any construction within its authorized franchise area. Instead, the City's case rested  x entirely on contentions that lack of headtohead competition and that Century had not extended its system into that  x portion of San Buenaventura served by Avenue. We decline to fault Century for not meeting an evidentiary showing  zP'the City did not make. See also, 47 C.F.R.  1.115 (c). Century argues that this  S' xevidence of system expansion demonstrates that the San Buenaventura Order erred in assuming that its  xcable system has not been extended since the 1983 franchise renewal. Century argues further that such  S' xgadditional construction eliminates the "important difference" which the San Buenaventura Order found  S' xIbetween the facts in Daniels and in this case and which supported the findings of lack of effective  Sv' xcompetition. Century contends that the San Buenaventura Order's assumption that no additional service  xarea expansion occurred is shown to be without foundation, irrational and arbitrary. Century further  xargues that the system construction maps it submitted to the City contained no lines or other markings that  x may be construed as marking any service area boundary. Century also contends that, although maps  xsubmitted by Avenue contained marking that may be construed as defining a service boundary, Avenue's  xmarkings may not properly be attributed to Century as evidence that Century redefined its service area.  S' x Finally, Century asserts that the Commission's rulings in the First Order On Recon and Valley Center  xmake it clear that the absence of headtohead competition is immaterial to the issue of effective  xcompetition, and that the City failed to satisfy its burden of proving that Century redefined its franchise": ,-(-(ZZd"  S' xarea as found in the San Buenaventura Order. The City points out that none of Century's system  xexpansion described in the petition for reconsideration is within Avenue's service area, and that Century does not contend otherwise.  Sb' e 6.` ` After further consideration of the record, including information submitted by Century  xshowing system expansion only within that portion of its service area not served by Avenue, we affirm  S' x^the San Buenaventura Order and its conclusion that Century is not subject to effective competition within  S' xthe San Buenaventura franchise area not served by Avenue. We find the analysis in the San Buenaventura  S' xMOrder of the Commission's criteria for cable operator redefinition of its service area and its application  xof the competing provider test to be fully supported by the record of this proceeding. The findings and  Sx' x@conclusions of the San Buenaventura Order are fully consistent with the Commission's analysis in the  SR ' x&First Order On Recon of the effective competition provisions of Section 632 of the Act as well as the  S, 'application of those provisions in Valley Center.  S ' e '7.` ` In construing Section 623, the Commission noted that there may be some limited situations  xwhere use of a more restricted definition of franchise area than the whole authorized franchise area may  xbe appropriate in applying the statutory tests for effective competition, and mentioned as an example  x@where a system operator has countywide operating rights but has determined to serve only a specific  S>' xnamed community within that area.L>\= zP'ԍFirst Order On Recon, at 1181.L We do not believe the Commission intended for that one example  xto represent the only factual situation in which it may reasonably be concluded that a cable operator has  xZredefined its franchise area. The issue is whether Century, "through its own conduct, self-defined the  xareas to be served to such an extent that this redefined area accurately portrays the operator's 'franchise  S' xarea.'"VZ\= zP'ԍFirst Order on Recon, 9 FCC Rcd at 1180.V The evidence in this proceeding is clear that San Buenaventura has been divided into two  xdiscrete areas where cable television service is provided. The Century system, in operation since the early  x1970s, has served the eastern portion and has not crossed the de facto dividing line between its service  xarea and the western portion, served by Avenue TV Cable, during that period. The Commission has said  xthat "The fact that a franchise area has not as yet been filled out by construction of a system would not  S' xDby itself be taken as redefining the service area."V\= zPb'ԍFirst Order on Recon, 9 FCC Rcd at 1180.V Century, on reconsideration, provides information that  xit has continued to construct physical plant and add subscribers, suggesting that it has continued to expand  x^its service area. However, the information provided demonstrates only that its additional construction has  x@taken place only within the eastern portion of the franchise area. In this respect this case is unlike the  S6' xcases Century cites. Thus, for example, in Valley Center the Commission specifically noted that additional  S' xconstruction had taken place "some twenty miles north of Valley Center."~\= zP."'ԍValley Center Cable Systems, L.P., 10 FCC RCD 11940, 11945 (1995) ("Valley Center"). In Daniels Cablevision (Pala  S' xMesa) the system had nearly doubled its subscriber base and physical plant over the preceding 10 years,  S' xincluding areas outside its "areas of primary responsibility."P\= xPt%'ԍ12 FCC Rcd 16594, 1659798 (1997).P In Daniels Cablevision (Encinitas) it was  xuncontested that the operator had "built it system in several portions of Encinitas unconnected to its",-(-(ZZ"  S' xprimary service area, including [overbuilt areas]."G\= xPh'ԍ12 FCC Rcd 17410, 17412 (1997).G We do not believe the Commission intended in Valley  S' xZCenter to suggest that failure to expand into areas served by another cable operator may not constitute  xevidence of service area redefinition, particularly where as here the evidence, including that submitted with  xCentury's petition for reconsideration, shows no system expansion outside its western service area since  xits franchise renewal in 1983, that is for more than a decade and a half. This record establishes more than  x@merely that Century has not yet filled out its service area, it provides substantial evidence that Century  xhas no intention to expand its system into the portions of San Buenaventura not now served and has thus  xredefined its service area to include that part of the City of San Buenaventura not served by Avenue.  S' xAccordingly, we affirm the findings of the San Buenaventura Order that Century fails to satisfy the second  S' xZleg of the competing provider test within its redefined service area,jZX\= xP ' x ԍThe second leg requires that the number of households subscribing to multichannel video programming other  xZ than the largest multichannel video programming distributor exceeds 15 percent of the households in the franchise  zP& 'area. See 47 C.F.R.  76.905(b)(2).j and that Century is not subject to effective competition within that redefined service area.
