MediaOne conducted signal strength tests of WOAC's signal at Mediaone's Mentor, Elyria,  xand Peru headends, and argues that, based on those tests, it is highly unlikely that WOAC provides an  S5(adequate offair signal to any of the individual households located in the communities at issue.D5  yO(ԍPetition at 5 and Exhibit 4.D  S( ` 9.` ` MediaOne argues that it has been unable to identify any local programming provided by  S ( x8WOAC to the relevant communities.7  {O(ԍId. at 6.7 MediaOne maintains that WOAC's programming consists almost  Si ( xentirely of home shopping that is not targeted to any particular community.9i  {O)(ԍId. at n.7.9 MediaOne states that  xWOAC's programming is not listed in the local television programming guides or in the Northern Ohio  S ( xedition of TV Guide.H  {OU(ԍId. and Exhibits 5 and 6. H  MediaOne further states that it carries a number of broadcast television stations  xwhich provide Grade B contour coverage to the communities, an offair signal, and extensive coverage  S ( x.of local news and sporting events. MediaOne states that these stations include WJW (Fox), WEWS (ABC), WKYC (NBC), and WOIO (CBS).  {OL!(See Exhibit 7.` `  With regard to local viewing, MediaOne argues that WOAC has no  xsignificant viewership in the communities largely because of the station's inability to deliver a Grade B  S8( xsignal or an offair signal to the communities at issue.E8 {Ox$(ԍId. at 7 and Exhibit 8.E MediaOne thus concludes that WOAC fails to meet any of the four statutory criteria for mandatory carriage in the cable communities at issue. "2,|(|(,,"Ԍ S( ` f10.` ` In opposition, WOAC states that the Commission has affirmed its mustcarry rights  S( x(throughout MediaOne's Elyria and Mentor cable systems. {O5(ԍOpposition at 2 citing Cablevision of Cleveland, L.P. and V Cable, Inc., 12 FCC Rcd 15173, 15183 (1997). With regard to MediaOne's Peru cable system,  xWOAC concedes that the communities served by that system are "substantially beyond the station's Grade  Sg( x8B contour."8gZ {Oa(ԍId. at 2.8 WOAC argues that MediaOne's failure to carry WOAC's signal in the past has no bearing  S4( xon the station's mustcarry rights.4 {O( xԍOpposition at 13 citing Time Warner Cable, 10 FCC Rcd 936, 938 (1995) and North Central Cable  {O ( xrCommunications, Inc., 10 FCC Rcd 4381, 4383 (1995) (failure to establish historic carriage should not be given great  {OT ( xweight); Kansas City Cable Partners, 10 FCC Rcd 3807, 3809 (1995) (congress enacted the mustcarry provisions  {O ( xin part to remedy past discriminatory practices); and Time Warner Cable, 10 FCC Rcd 8045, 8048 (1995) and Time  {O ( xWarner Cable, 10 FCC Rcd 6663, 6667 (1995) (affording weight to historic carriage prevents smaller stations from ever being carried).  WOAC states that, as evidence of its nexus to the communities, its  S( xsignal is carried on cable systems that are nearby or adjacent to MediaOne's Elyria and Mentor systems.9n  yO(ԍOpposition at 13.9  xSpecifically, WOAC states that it is carried on cable systems serving Chardon and Thompson, Ohio which  xare adjacent to MediaOne's Mentor cable system and on systems serving Lorain and Vermilion, Ohio,  Sh( xBwhich are adjacent to MediaOne's Elyria cable system.2h  {O(ԍId. 2 With regard to coverage or other local service,  xWOAC argues that MediaOne has inaccurately portrayed the contours of WOAC's Grade B contour. In  xfact, WOAC states that the Commission has previously refused to exclude from WOAC's television market  xcertain communities which are adjacent to MediaOne's Elyria and Mentor cable systems because they  S ( xlie within WOAC's Grade B signal contour or within its fringe.z  {O(ԍId. at 6 citing Cablevision of Cleveland, 12 FCC Rcd at  26.z WOAC argues that, in this case, all of  xthe communities served by MediaOne's Elyria and Mentor cable systems lie within or on the fringe of  S6 ( xWOAC's Grade B contour.8 6 " yO(ԍOpposition at 7.8 Moreover, WOAC argues that MediaOne's assertion that WOAC is not  xavailable offair is based upon one signal test the results of which the Commission has previously rejected  S ( xNas untrustworthy.7!  {O"(ԍId. at 8.7 WOAC states that the Commission concluded that the signal test cited in this  S (proceeding failed to comply with sound engineering practices." S9( ` V 11.` ` With regard to other local service, WOAC maintains that, while the vast majority of its  xprogramming is a home shopping format, it airs local affairs and children's programming including a  x$weekly local public affairs program, "Dialogue," which allows community leaders and representatives of  x`civic groups to discuss significant issues affecting the residents of the Cleveland ADI. WOAC states that  x"Dialogue" has interviewed representatives of local organizations including the Urban League of  xpCleveland, Victim Resource Center, Laurelwood Hospital, Ohio Ballet, Cuyahoga Valley Association,":",|(|(,,"  S( xNCA Financial Planners, among others.8# yOh(ԍOpposition at 4.8 WOAC also states that it airs three hours weekly of advertiser S( xrestricted children's programming.7$X {O(ԍId. at 9.7 WOAC states that, with regard to television guide and newspaper  x`listings, the fact that Clevelandarea publications do not list the station is not an indication that the station  xis not local but has more to do with its predominate format, i.e., a home shopping format which is less  S4(dependent on these types of listings.8%4 {O(ԍId. at 10.8  S( ` 12.` ` WOAC maintains that, with regard to other local programming, MediaOne carries  x`WOAC's VHF competitors who, like WOAC, broadcast from sites at or near the center of the Cleveland  Sh( x`ADI.7&h| {O (ԍId.7 This fact, WOAC argues, weighs in favor of its position that the communities at issue are part of  xWOAC's television market. WOAC suggests that MediaOne's carriage of other home shopping networks  xsuch as QVC, the Home Shopping Network, and two channels showing infomercials may indicate that its  S(real objection to WOAC is competitive in nature.p' yO}(ԍOpposition at 4 and Petition at Exhibit 7 (MediaOne's channel lineups).p  Si ( ` j13.` ` With regard to viewing patterns, WOAC maintains that it collects zip code information  xfrom its Shop at Home service which shows that the station is viewable in the communities at issue.  xWOAC states that, in communities served by MediaOne's Elyria and Mentor systems, Shop at Home has  S ( xreceived an average of 75.5 calls from viewers in Mentor, Ohio, resulting in average sales of $15,968.69q(  {O(ԍId. at 11 and Declaration of Sheryl Stewart, attached as Exhibit 3.q  S ( xand an average of 26.3 calls from viewers in Elyria, Ohio, resulting in average sales of $5,591.64.1) 0  {Om(ԍId.1  xWOAC argues that its viewership must be more extensive than indicated by the product sales because only  S7(a portion of WOAC's viewers make product purchases.1*7  {O(ԍId.1  S( ` *14.` ` MediaOne replies that WOAC does not contest its request to delete from WOAC's  S( xtelevision market the 43 communities served by MediaOne's Peru system.3+T  yO (ԍReply at 3.3 With regard to the remaining  x 22 communities served by MediaOne's Elyria and Mentor cable systems, MediaOne maintains that WOAC  S8( xhas no local nexus with those communities.=,8 {O#(ԍId. at 4.= MediaOne reiterates that WOAC does not provide local  xprogramming to those communities and is unlikely to provide a quality offair signal. MediaOne states  xlthat the signal tests relied upon in its petition comply with the Commission requirements for signal"v,,|(|(,,|"  S( xtesting.7- {Oh(ԍId. at 8.7 With regard to WOAC's Grade B coverage, MediaOne discounts WOAC's assertion that the  x.communities served by MediaOne's Elyria and Mentor systems lie either outside or just within WOAC's  xGrade B contour. With regard to viewership, MediaOne states that WOAC's telephone call data represent  Sg(0.05 percent of Elyria's 56,746 residents and 0.16 percent of Mentor's 47,358 residents.;.gZ {Oa(ԍId. at 1213.;  S( IV.DISCUSSION  S( ` 15.` ` We grant, in part, and deny, in part MediaOne's request to modify the television market  xof WOAC. As an initial matter, we note that in the legislative history of the 1992 Cable Act, the use  x of ADI market areas is intended "to ensure that television stations be carried in the areas which they  S( xservice and which form their economic market."/ yO (ԍ#X\  P6G;QwP#H.R. Rep. 102628, 102d Cong., 2d Sess. 97 (1992). Changes may be sought and granted by the  S( xFCommission "to better effectuate the purposes" of the mandatory carriage requirements.d0| yO(ԍ#X\  P6G;QwP#47 U.S.C. 534(h).d The ADI market  xchange process incorporated into the Communications Act, however, is not intended to be a process  xwhereby cable operators may seek relief from the mandatory signal carriage obligations apart from the  xvquestion of whether a change in the market area involved is warranted. When viewed against this  x>backdrop, and balancing all of the relevant factual circumstances in the record, we grant MediaOne's  xjrequest to exclude the 43 communities served by its Peru cable system and we deny MediaOne's request  xBto exclude the remaining 22 communities served by its Elyria and Mentor cable systems. With regard to  xcommunities served by MediaOne's Peru system, WOAC concedes that it fails to place a Grade B contour  xover those communities and WOAC also fails to introduce other evidence to meet any of the remaining  xstatutory criteria. We evaluate MediaOne's request to exclude communities served by its Elyria and Mentor systems in the context of evidence introduced in the record in light of the four statutory factors.  Sk( ` 16.` ` With regard to the first factor, WOAC has no history of carriage in the communities  xLserved by MediaOne's Elyria and Mentor cable systems despite the fact that WOAC began operations in  S( x1982.m1  {O(ԍTelevision and Cable Factbook, No. 66 (1998 Edition), at A869.m WOAC asserts that its lack of historical carriage should be given little weight in this proceeding  xbecause MediaOne has engaged in delaying tactics to deny WOAC's mustcarry rights. WOAC also  xHargues that this factor should be weighed against the fact that the television station is carried on cable  xsystems which are nearby MediaOne's Elyria and Mentor systems. The fact that WOAC has been  x>operating since 1982 without carriage on MediaOne's cable systems serving the communities at issue  xNweighs in favor of MediaOne's request to exclude those communities from WOAC's market. The  xCommission has stated, however, that historic carriage of television stations in the same area is a factor  x~to be considered because carriage of other television stations may indicate a belief that a common market  Sm( x`exists between the station involved and the cable communities at issue.2m {O$(ԍSee DeSoto Broadcasting, Inc., 13 FCC Rcd 2769, 2779 (1998) ("DeSoto Broadcasting").Ď In this case, WOAC states that  xMediaOne carries its VHF competitors serving the Cleveland ADI. MediaOne's channel lineups show  xthat it carries television stations WKYC3 (NBC), WUAB43 (UPN), WEWS5 (ABC), WOIO19 (CBS),"0 2,|(|(,, "  S( xjand WJW8 (FOX).>3 yOh(ԍPetition at Exhibit 7.> WOAC maintains that because its transmitter is located 15 miles north of Canton,  x8Ohio in the centraleastern portion of the Cleveland ADI, its Grade B coverage contours are comparable  xrto, although covering less territory than, the contours of the other television stations carried by  Sg(MediaOne.84gX yO_(ԍOpposition at 3.8  S( ` 17.` ` Carriage on nearby cable systems is not a factor enumerated in the statute, but it also  xseems reasonable, depending upon the specific circumstances involved, that carriage on nearby systems  S( xcould serve as evidence to define the logical scope of a station's market.p5 {O# (ԍSee Fouce Amusement Enterprises, Inc., 10 FCC Rcd 668, 671 (1995).p Such carriage could also serve  xHto demonstrate market nexus between the broadcast station and the communities where the station is  xcarried and thus provide evidence of the scope of the station's market. WOAC maintains that it is  x currently carried on systems serving Chardon and Thompson, Ohio communities which are located  xVadjacent to MediaOne's Mentor system and that, pursuant to a Commission order, it will soon be carried  xpon Adelphia Cablevision's systems serving Lorain and Vermilion which are nearby MediaOne's Elyria  Si ( xsystem. 6i z {O( xԍOpposition at 13 citing SAH Acquisition Corporation II, Licensee of Television Station WOAC, Canton, Ohio  {OM(v. Adelphia Cablevision Associates, L.P. a/k/a Adelphia Cable Communications, 13 FCC Rcd 16334 (1998).  While MediaOne concedes that "carriage in Chardon and Thompson approaches some of the  S6 ( x[its] Mentor system communities,"376  yO(ԍReply at 4.3 it also maintains that the Mentor system is "generally beyond such  S ( xcurrent carriage of WOAC."78 f  {O (ԍId. at 5.7 With regard to WOAC's carriage on cable systems serving Chardon and  xThompson, MediaOne argues that its Elyria system is located in Lorain County which is "more than 40  S (miles away from either Chardon and Thompson."79  {O5(ԍId. at 4.7  S7( ` 18.` ` Local service, statutory factor two, incorporates both technical service and programming  S( xzservice. With regard to technical service, the Commission has stated in its Must Carry Order that "to  xshow that the station provides coverage or other local service to the cable communities, parties may  xdemonstrate that the station places at least a Grade B coverage contour over the cable community or is  Sl( xlocated close to the community in terms of mileage.?:l  yO (ԍ8 FCC Rcd at 29762977.? We focus here more heavily on technical service  xas evidenced by WOAC's Grade B coverage contour to provide evidence of the market boundaries of the  xtelevision station. The record shows that the communities served by MediaOne's Elyria and Mentor  S( x8systems lie within the fringe of WOAC's predicted Grade B contour. In Cablevision of Cleveland, L.P.  S( x>and V Cable, Inc. ("Cablevision of Cleveland"), the Commission declined to exclude from WOAC's" :,|(|(,,"  xmarket certain communities which were located within the fringe of the television station's Grade B  S(contour.I;( {O5( xԍ12 FCC Rcd 15173, 15181 (1997), see also Time Warner Cable, 10 FCC Rcd 8040, 8044 (communities up to  {O( x65 miles outside of Grade B contour included in television market); Erie County Cablevision, Inc., 13 FCC Rcd 6403,  {O( xP6409 (communities ranged from 3 to 11 miles outside of station's Grade B contour); and TWI Cable, Inc., 12 FCC  {O(Rcd 13187, 13192 (1997) (community located 40 miles outside of station's Grade B contour).  I  Sg( ` 19.` ` The third statutory factor, whether other stations eligible to be carried serve the relevant  xcable communities, is given greater weight where a cable operator is seeking to delete a station's  xmandatory carriage rights in certain communities and it is clear that the station is not providing local  S( x.service to those communities.Z< {O& (ԍSee DeSoto Broadcasting, 12 Fcc Rcd at 2779.Z In this instance, MediaOne argues that it provides carriage to numerous  xstations that provide local service to subscribers in the cable communities at issue. WOAC maintains that  xthis factor should be given little weight in this proceeding. We find that WOAC has provided evidence of its local service through its Grade B contour coverage and its fringe.  S( ` 20.` ` With regard to viewing patterns, statutory factor four, MediaOne has presented evidence  S ( xtto show that WOAC has no significant viewership in the cable communities at issue.D= J yO(ԍPetition at 7 and Exhibit 8.D In Cablevision of  Sj ( x$Cleveland, the Commission noted that WOAC's programming format consists largely of home shopping  S8 ( xand that these types of specialty stations typically attract limited audiences.f>8  {O(ԍSee Cablevision of Cleveland, 12 FCC Rcd at 15182.f Thus, the weight of this factor is mitigated by WOAC's programming format.  S ( ` 21.` ` We have carefully considered each statutory factor and other relevant factors in the context  x$of the circumstances presented here. We are under no obligation to give particular weight to any one of  S9( xRthe several factors under consideration.?9l  yOE( xԍThe Commission has noted that it is under no obligation to give particular weight to any particular one of the  {O ( xstatutory factors. See Cablevision, 12 FCC Rcd at 15183, n.34, see also Time Warner Entertainment Co. v. FCC,  {O( x56 F.3d 151, 175 (D.C. Cir. 1995); accord Omnipoint corp. v. FCC, 78 F.3d 620, 633634 (D.C. Cir. 1996) (When  xCongress directs an agency to consider certain factors, the agency simply "must reach an express and considered conclusion about the bearing of a factor, but is not required to give any specific weight to it").  However, given the difficulties of relying exclusively on the  xRstatutory factors of historical carriage and viewing patterns, which could severely narrow the carriage  xrights of stations even within what is their local market area, we find it necessary to focus more heavily  S( xon factors other than one and four, i.e., those that are not influenced by the type or age of the stations  xinvolved or historical carriage. We have, however, considered WOAC's carriage on cable systems nearby  xMediaOne's Mentor system. We have also taken into consideration MediaOne's carriage of several  xtelevision stations licensed to Cleveland and two stations licensed to Akron, Ohio, a city which is less than  S( x10 miles from WOAC.@$  {O$( xZԍSee Cablevision of Cleveland, 12 FCC Rcd at 15182 (WOAC, with its recently upgraded facilities, is located  {O_%( xxat Brimfield, Ohio which is less than 10 miles from Akron); see also House Committee on Energy and Commerce,  xCable Television Consumer Protection and Competition Act of 1992, H.R. Rep. No. 102628, at 98. (Congress sought to prevent cable operators from discriminating among stations).  In this case, we find that the cable communities served by MediaOne's Elyria" @,|(|(,,"  xand Mentor systems lie within the fringe of WOAC's Grade B contour. Considering the record as a  xVwhole, we find that MediaOne has failed to demonstrate that the requested exclusion of the communities  xserved by its Elyria and Mentor cable systems from the television market of WOAC will better effectuate  xthe purposes of the mustcarry statutory provisions. With regard to the communities served by  x$MediaOne's Peru system, we find that MediaOne has demonstrated that those communities are not part  x~of WOAC's television market. Accordingly, we grant MediaOne's request to exclude those communities from WOAC's television market.
