The first Prior Order ("First Order") addressed complaints filed against Operator's  SY- d(#CPST rates effective September 1, 1993 through May 14, 1994.hYir {O-#X\  P6G;P#э  #X\  P6G;P#In the Matter of HiDesert Cablevision, 10 FCC Rcd 7588 (1995). This order was subsequently stayed by  {O-In the Matter of Battlefield Cable TV Co. 10 FCC Rcd 10591 (1995).#Xj\  P6G;9XP#h The second Prior Order ("Second  S1- d(#Order")1$ir {O-#X\  P6G;P#э #X\  P6G;P#In the Matter of Booth American Company, 12 FCC Rcd 21280 (1997).#Xj\  P6G;9XP# dismissed CPST rate complaints in CUID CA0003 (Apple Valley), CUID CA0846 (Victorville)  d(#and CUID CA1247 (Hesperia) because Operator qualified for small operator status pursuant to the  S- d(#Telecommunications Act of 1996 ("1996 Act").ir yO7-#X\  P6G;P#э #X\  P6G;P#Pub. L. No. 104104, 110 Stat. 56 (February 8, 1996). On August 9, 1995, Operator filed an application for  S- d(#jreview ("Application") for the first Prior Order. On April 30, 1998, Operator filed a motion ("Motion")  d(#\requesting that CUID CA0072 (Victorville) be considered unregulated pursuant to the small operator  d(#-provisions of the 1996 Act. On May 8, 1998, Operator filed a petition requesting that the Bureau consider  d(#its Application as a petition for reconsideration. In this Order, we grant Operator's petition and consider its application for review as a petition for reconsideration. We also address Operator's Motion.  S-  2.` ` The Communications ActFir {O#-#X\  P6G;P#э#X\  P6G;P# Section 623(c) of the Communications Act of 1934, as amended, 47 U.S.C. Section 543(c) (1996).#Xj\  P6G;9XP# authorizes the Federal Communications Commission  d(#("Commission") to review the CPST rates of cable systems not subject to effective competition to ensure  d(#that rates charged are not unreasonable. The Cable Television Consumer Protection and Competition Act  SS- d(#zof 1992Sir yO'-#X\  P6G;P#э #X\  P6G;P#Pub. L. No. 102385, 106 Stat. 1460 (1992). ("1992 Cable Act") required the Commission to review CPST rates upon the filing of a valid"Sh ,))II"  d(#complaint. If the Commission finds the rate to be unreasonable, it shall determine the correct rate and  S-any refund liability.rW {O@-#X\  P6G;P##X\  P6G;P#э #X\  P6G;P#See 47 C.F.R. Section 76.957.  S-  3.` ` In its petition for reconsideration, Operator raises four issues. In its first issue, Operator  d(#argues that the rate complaints adjudicated by the Bureau in the First Order were properly withdrawn by  d(#the complainants in communities CUID CA0003 (Apple Valley), CUID CA0072 (Victorville) and CUID  d(#CA0846 (Victorville) prior to the release of the First Order. Our review of the record shows that each  S- d(#complainant wrote to the Commission and requested the dismissal of his or her complaint."ZrW {O -#X\  P6G;P##X\  P6G;P#э See Letter of Judy Carlos to the Federal Communications Commission, dated April 11, 1995 (CUID CA0846); Letter of Michelle Marek to the Federal Communications Commission, dated April 17, 1995 (CUID CA0072); and Letter of Randy Morgan to the Federal Communications Commission, dated April 5, 1995 (CUID CA0003).  Each of these  d(#requests was dated in April 1995 while the First Order was released on July 10, 1995. Under our rules,  S- d(#this Commission will regulate CPST rates only when a valid complaint against those rates is filed.DrW {O|-#X\  P6G;P##X\  P6G;P#э See  47 C.F.R. Sections 76.953, 76.954. In  d(#.each of the three communities referenced, the only complainant against the Operator in the communities  d(#zrequested the dismissal of his or her complaint prior to the release of the First Order. While our rules  d(#Mforbid collusive agreements regarding forbearance from rate regulation, there is no evidence of such an  d(#agreement here. Therefore, we will allow the complainants to withdraw their complaints and vacate the  d(#Prior Order concerning communities CUID CA0003 (Apple Valley), CUID CA0072 (Victorville) and CUID CA0846 (Victorville).  SX-  B4.` ` In its second issue, Operator argues that it is subject to effective competition in CUID  d(#CA0846 (Victorville). Because we are dismissing the complaint in that community pursuant to the complainant's request, we do not reach this issue.  S-  5.` ` In its third issue, Operator argues that Booth is subject to effective competition in CUID  d(#.CA1247 (Hesperia). Operator states that, at the time the complaint was filed, it served 913 subscribers  Sh- d(#in Hesperia over 35 miles of cable plant which passed approximately 1430 households. hrW yO-#X\  P6G;P##X\  P6G;P#э Petition for reconsideration at 8. Operator  d(#contends that, according to the 1990 U.S. Census Report, the City of Hesperia had approximately 16,551  S- d(#.households in 1990. f rW {O -#X\  P6G;P##X\  P6G;P#э Id.Ā Operator concludes that it provided service to only six percent of the households  S-in Hesperia and is therefore subject to effective competition under our rules.y  rW {O"-#X\  P6G;P#э See 47 C.F.R. Section 76.905(b)(1).y   S-  6.` ` In the absence of a demonstration to the contrary, cable systems are presumed not to be  Sx- d(#subject to effective competition. x rW yO&-#X\  P6G;P##X\  P6G;P#э 47 C.F.R. Section 76.906. The cable operator bears the burden of rebutting the presumption that"x ,>(>(II"  d(#effective competition does not exist with evidence that effective competition, as defined by section 76.905  S- d(#of the Commission's rules, is present within its franchise area. rW yO@-#X\  P6G;P##X\  P6G;P#э 47 C.F.R. Section 76.911(b)(1). According to Section 76.905(b) of the  d(#Commission's rules, [a] cable system is subject to effective competition when . . . [f]ewer than 30 percent  S- d(#of the households in its franchise area subscribe to the cable service of a cable system."XrW yO-#X\  P6G;P##X\  P6G;P#э 47 C.F.R. Section 76.905(b). Our review of  d(#the record before us shows that, at the time the complaint in Hesperia was filed, Operator provided cable  S8- d(#service to 913 subscribers while the total number of households in Hesperia was 16,551.P$8rW yO -#X\  P6G;P##X\  P6G;P#э In rate complaint proceedings, the Commission requires cable operators defending against such complaints on the basis of effective competition to use subscriber data derived from the approximate time the CPST  {OP -complaint was filed. In the Matter of Comcast Cablevision of Santa Ana, Inc., 12 FCC Rcd 19427 (1997). The  {O -Commission has also stated that 1990 U.S. Census data is an appropriate measure of households. Id.P A comparison  d(#of the total number of subscribers as of 1994 (913) to the total number of households (16,551) yields a  d(#[penetration rate of 5.51 percent. Accordingly, Operator was subject to effective competition at the time  d(#Lthe complaint in Hesperia was filed. Therefore, we will vacate that portion of the First Order subjecting Operator's cable system in CUID CA1247 (Hesperia) to CPST rate regulation.  SH - 7.` ` Operator's fourth and final issue concerns whether the Commission permitted Operator  d(#>to account for external cost increases incurred during the period of time from the effective date of the  d(#1992 Cable Act through the initial date of regulation in its CPST rates (the "Gap Period"). Operator states  S - d(#.that in Time Warner Entertainment Co. v. FCC, rW yOD-#X\  P6G;P#э#X\  P6G;P# 56 F.3d 151 (D.C. Cir. 1996). the United States Court of Appeals for the District of  d(#-Columbia Circuit held that the Commission improperly failed to permit cable operators to adjust their rates  d(#to account for these external cost increases. Operator concludes that it is entitled to offset any refunds  d(#owed with any Gap Period external costs that it did not collect. Subsequent to Operator's filing of its  d(#Petition, the Commission issued an order ("Gap Period Order") and amended its rules to allow certain  d(#cable operators which had not collected external costs incurred during the Gap Period to collect those costs  S- d(#by adjusting their CPST rates.hd rW {O-#X\  P6G;P#э#X\  P6G;P# See In the Matter of Implementation of the Cable Television Consumer Protection and Competition Act of  {O-1992, 11 FCC Rcd 20206 (1996) ("Gap Period Order"). See also 47 C.F.R. 76.922(f)(4), which became effective on August 13, 1997. The Gap Period Order was appealed to the U.S. Court of Appeals for the District of  {OB-Columbia which partially vacated the Gap Period Order. See Time Warner Entertainment Company v. FCC, 144  yO -F.3d 75 (D.C. Cir. 1998). The Commission filed a#X\  P6G;P# Petition for Rehearing and Suggestion for Rehearing of the  yO-Court's most recent decision on July 6, 1998.#Xj\  P6G;9XP#h Therefore, to the extent that Operator is entitled to take an adjustment for external costs incurred during the Gap Period, it may do so pursuant to the Commission's rules.  Sj- 8.` ` In its Motion, Operator requests that its cable system in CUID CA0072 (Victorville) be  d(#considered unregulated pursuant to the small operator provisions of the 1996 Act. In the 1996 Act,  d(#Congress amended Section 623 of the Communications Act and redefined a small cable operator as one  d(#.that "directly or through an affiliate, serves in the aggregate fewer than 1 percent of all subscribers in the  d(#United states and is not affiliated with any entity or entities whose gross annual revenues in the aggregate",>(>(II"  S- d(#/exceed $250,000,000."rW {Oh-#X\  P6G;P##X\  P6G;P#э Section 623(m)(1) of the Communications Act, as amended, 47 U.S.C. Section 543(m)(1) (1996). See  {O2-also 47 C.F.R. Section 76.1403(a). In our Second Order, we determined that Operator is a small cable operator  d(#pursuant to the 1996 Act. Because Operator certifies that its cable system in CUID CA0072 (Victorville)  d(#Mdoes not serve more that 50,000 subscribers, we find that Operator's cable system in CUID CA0072 (Victorville) is entitled to small operator treatment pursuant to the 1996 Act.
