First,  xjTCIIA asserts that HMU qualifies as a multichannel video programming distributor ("MVPD") because  S - xit makes available for purchase, by subscribers or customers, multiple channels of video programming.  . U {O- x[ԍTCIIA Petition at 2 and Exhibit A (HMU channel lineup). See also  47 U.S.C.  522(13), 47 C.F.R.  76.905(d) (MVPD definition).  x-Second, TCIIA states that the citizens of Harlan voted in May 1995 to authorize HMU to begin operating  S - xa cable system in competition with TCIIA.> U yO-ԍTCIIA Petition at 3. > TCIIA states that HMU's cable system became operational  S - xin October 1996. U {O8-ԍId., Exhibit C (newspaper article stating that HMU began offering cable television service). TCIIA provides several newspaper articles on HMU's operations as evidence that  xHMU is municipally owned, and that HMU operates a cable system within TCIIA's Harlan franchise  S0-area.= 0U {Oz -ԍId., Exhibit B.=  S- ` x4.` ` Third, with regard to the requirement that the municipallyowned cable system offer  xservice to at least 50 percent of the households in the franchise area, TCIIA notes that HMU's overbuild  S- xof TCIIA in Harlan is 100 percent complete and its cable plant passes approximately 2, 592 households.;Z<U {Ol%- xxԍId., Exhibit E (email regarding August 28, 1997 meeting of HMU Board at which HMU officials announced  xthat HMU's overbuild of TCIIA's system (which passes 2, 592 households) was complete and that HMU had 1,002 customers at that time). ; "^,>(>(II"  xTCIIA also submits that, based on current figures, the City of Harlan has approximately 2,670  S- xkhouseholdsZFU {O@- xԍId., Exhibit D ("Hybrid Fiber/Coax Network Opens Doors," Transmission and Distribution World, September  x1996, at 1824). This same article states that Harlan, as the county seat, has 6,827 residents. For purposes of this  xpetition, TCIIA is seeking to revoke the certification for the City of Harlan, with approximately 2,670 residents,  xin the Harlan franchise area. TCIIA also notes that according to 1990 Census data, the City of Harlan, Iowa had  x<2,109 households in 1990 (1990 Census data also included in Exhibit D). The Commission has stated that 1990  xCensus data is an appropriate measure of households. Operators that have access to more recent data may submit  {O- xksuch information. See In the Matter of Cable Operators' Petitions for Reconsideration and Revocation of  {O-Franchising Authorities Certifications to Regulate Basic Cable Service Rates, 9 FCC Rcd 3656 (1994). Z (i.e., occupied, nonseasonal housing units).=ZU yON - xiԍAs TCIIA notes, for effective competition showings, the Commission has determined that parties must use  {O - x<the number of occupied, nonseasonal housing units. See Third Rate Reconsideration Order, 9 FCC Rcd at 4316 (1994).= Thus, according to TCIIA, HMU's cable  S- xservice is available to 97 percent of the households in the Harlan franchise area.= U yOJ-ԍTCIIA Petition at 3.= HMU also filed a letter  S- x!with the Commission indicating that as of August 27, 1997, HMU's cable system exceeded 1000  Sb- xjsubscribers. b U yO- xԍLetter to the Cable Services Bureau from Jim Conant, Communications Superintendent for HMU (September  xi5, 1997). The letter was filed pursuant to 47 C.F.R. 76.95(a) and 76.156(b) regarding the provision of service  xby HMU to 1,000 subscribers for purposes of serving as notification to television stations entitled to exercise network nonduplication and syndicated exclusivity protection against HMU.  TCIIA also provides a copy of HMU's channel lineup which indicates that HMU offers  S:-54 channels, including at least seven broadcast channels and numerous nonbroadcast channels.:pU yOJ- xԍTCIIA Petition, Exhibit A. TCIIA provides 39 channels of programming, including at least five broadcast  {O-channels and numerous nonbroadcast channels. See Exhibit A.  S- ` x5.` ` In the absence of a demonstration to the contrary, cable systems are presumed not to be  S- xsubject to effective competition.>U yO,-ԍ47 C.F.R. 76.906. > The cable operator bears the burden of rebutting the presumption that  xeffective competition does not exist with evidence that effective competition, as defined by Section 76.905  Sr-of the Commission's rules, is present within its franchise area.CrZU yOl-ԍ47 C.F.R. 76.911(b)(1).C TCIIA has met this burden.  S" - ` x6.` ` The municipal provider test requires that at least 50 percent of the households in the  x{franchise area be offered service by a municipallyowned cable system. TCIIA's evidence clearly  xestablishes that HMU is owned by the City of Harlan, and that HMU operates in TCIIA's Harlan  xfranchise area. With regard to the requirement that HMU offer service to at least 50 percent of the  x/households in Harlan, TCIIA's evidence indicates that there are approximately 2, 670 households in  xHarlan. To satisfy the 50 percent passage requirement, TCIIA must establish that HMU's system offers  xservice to at least 1,335 households in Harlan (50 percent of 2,670 households). TCIIA provides  xevidence that HMU offers service to 2,592 households, or 97 percent of the total households in Harlan  x %ld ԩsignificantly above the 1,335 households necessary to establish that HMU offers service to at least 50",>(>(II"  xpercent of the households in the franchise area. Although not a requirement of the municipal provider  xMtest, we also note TCIIA's evidence that HMU actually provides service to 1,000 households, or 37 percent of the households in the Harlan franchise area.  S`- ` x7.` ` Although the municipal provider test does not contain a comparable programming  S8- xyrequirement, we note that the programming of TCIIA and HMU are comparable.8U yO- x-ԍUnder the competing provider test for effective competition, competing multichannel video programming  {Oh- xdistributors ("MVPDs") must offer comparable video programming to households in the franchise area. See  yO2- xCommunications Act 623(1)(1)(B)(i), 47 U.S.C. 543(1)(1)(B)(i); 47 C.F.R. 76.905(b)(2). As the Commission  xhas stated previously, in order to provide "comparable" video programming, a MVPD must provide at least 12  {O -channels of video programming, including at least one nonbroadcast channel. See Rate Order, 8 FCC Rcd at 5667. Each provider offers at least 12 channels of video programming, including at least one nonbroadcast channel.  S- ` x8.` ` As TCIIA has submitted sufficient evidence demonstrating that its cable system serving  S-the City of Harlan is subject to municipal provider effective competition, its petition is granted. |U yO- xԍTCIIA also notes that it is subject to effective competition under the competing provider test set forth in 47  xU.S.C. 543(1)(1)(B). In light of our finding that TCIIA is subject to effective competition under the municipal  xprovider test pursuant to 47 U.S.C. 543(1)(1)(C), we find it unnecessary to address TCIIA's arguments regarding the competing provider test.   SH - III.xORDERING CLAUSES  S - ` p x9.` ` Accordingly, IT IS ORDERED that the petition for revocation filed by Heritage  xCablevision, Inc., d/b/a TCI of the Heartlands ("TCIIA") challenging the certification of the City of  S -Harlan, Iowa to regulate TCIIA's basic cable service and equipment rates IS GRANTED .  SX- ` x 10.` ` IT IS FURTHER ORDERED that the certification granted to the City of Harlan, Iowa  S0-to regulate Heritage Cablevision, Inc.'s basic cable service and equipment rates IS REVOKED .
