In its petition, TracFone requests that the Commission require all ETCs to retain a copy of the underlying documentation used to determine program-based Lifeline eligibility for at least three years following receipt of such documentation. TracFone Wireless, Inc Public Notice: The Wireline Competition Bureau (Bureau) seeks comment on an Emergency Petition for Declaratory Ruling and Interim Relief filed by TracFone Wireless, Inc. (TracFone) on February 22, 2012. In its petition, TracFone states that it received a letter from the Puerto Rico Telecommunications Regulatory Board (Board), directing TracFone to de-enroll, as of March 1, 2012, certain Lifeline subscribers found by the Board to be receiving duplicative Lifeline benefits. TracFone notes that a second letter directed the company to de-enroll, as of April 1, 2012, certain Lifeline subscribers found by the Board to be receiving more than one Lifeline benefit per family unit. According to the petition, de-enrolled subscribers would be barred from re-enrolling in Lifeline for four months following their de-enrollment by the eligible telecommunications carrier (ETC). TracFone asserts that the Board’s process for resolving duplicative Lifeline subscriptions is inconsistent with Section 254 of the Communications Act of 1934, as amended, as well as the Commission’s Lifeline Reform Order.TracFone requests that the Commission issue an order concluding that the Board’s directives to TracFone and other ETCs are unlawful, and the Commission should preempt the Board’s duplicate resolution process.

Comments Sought on Funding Pilot Program Participants Transitioning Out of the Rural Health Care Pilot Program in FY 2012 Public Notice: The Wireline Competition Bureau (Bureau) seeks comment on whether to fund Rural Health Care Pilot Program (Pilot Program) participants who will exhaust funding allocated to them before or during funding year 2012 (July 1, 2012-June 30, 2013). This funding would maintain support for qualifying Pilot Program participants, on an interim basis, during the 2012 funding year to provide time to establish a process to transition them into the permanent Rural Health Care support mechanism (RHC support mechanism). To support these transitioning Pilot Program participants, the funds that were previously designated for projects that withdrew from the Program or otherwise failed to meet the June 30, 2011, deadline could be used without increasing overall demand.

Bureau seeks comment on a petition filed by the Ad Hoc Coalition
of International Telecommunications Companies. In that petition,
the Coalition requests that the Commission commence a rulemaking

for carriers’ reporting of revenues from the provision of
service to other carriers (i.e., wholesale revenues) for purposes

Verizon-Frontier Study
Area Waiver Public Notice (DA 10-300): Verizon California
and Frontier seek a waiver of the study area boundary freeze
to transfer seven exchanges from Verizon California’s existing
California study area to a newly created Frontier study area
in California. Verizon South and Frontier also seek a waiver
of the study area boundary freeze to transfer all exchanges,
with the exception of the Knotts Islands exchange, from Verizon
South’s existing North Carolina study area to a newly created
Frontier study area in North Carolina. The study area waiver
requests are in connection with the transaction in which Verizon
proposes to transfer operating companies in a number of states
to Frontier. The attached public notice seeks comment on the
requested study area waiver. |

E-rate Community Use Order: In this order, the Commission waives, on its own motion, through funding year 2010 (which ends June 30, 2011), rules that currently discourage public use of resources funded by E-rate. In the notice of proposed rulemaking, the Commission seeks comment on revising its rules to make the change permanent. This change will leverage universal service funding to serve a larger population at no increased cost to the E-rate program. The general public will be able to use the Internet access already present in schools, at the schools’ discretion, for purposes such as job searches and applications, digital literacy programs, and online access to governmental services and resources. |

Protecting Children in the
21st Century Act Public Notice: On November 5, 2009, the Commission released a notice of proposed rulemaking (NPRM) seeking comment on revising rules regarding the schools and libraries universal service support mechanism, also known as the E-rate program, to comply with the requirements of the Protecting Children in the 21st Century Act. Among other things, section 215 of the Protecting Children in the 21st Century Act, titled Promoting Online Safety in Schools, revised section 254(h)(5)(B) of the Communications Act of 1934, as amended, by adding a new certification requirement for elementary and secondary schools that have computers with Internet access and receive discounts under the E-rate program. The Commission also proposed to revise related Commission rules to reflect existing statutory language more accurately. Interested parties may file comments on or before February 18, 2010, and reply comments on or before March 5, 2010. |
