In compliance with the Commission's proposed merger timeline, Commission staff, James Bird, Claudia Fox, Pamela Megna and I met with Brad Stillman of MCI WorldCom, Richard Metzger of Lawler, Metzger & Milkman, Leon Kestenbaum of Sprint, and Sue Feldman of Willkie, Farr & Gallagher on April 18, 2000 (day 74) to discuss whether the Commission has the information it needs to fully consider the applications relating to the proposed license transfer between MCI WorldCom and Sprint (Applicants). The staff informed the Applicants that, as might be expected in a merger of this size and complexity, it needs some additional information. Specifically, staff asked the Applicants to submit additional information on the Internet and long distance markets and to provide certain consultant reports that are relevant to this information.
Accordingly, the proposed 180-day clock outlined by the Commission on March 1, 2000 has stopped on day 75 until staff has received the requested information and issues a completeness review letter. The staff also explained that the Commission's consideration of the applications relating to this proposed license transfer is one of the "test cases" being used to try out the proposed time line and see what modifications might be necessary or useful (e.g., is day 75 a realistic time to conduct a "completeness review" in the "most complex cases.") Comments on the timeline based on its specific application to this and other cases, by the applicants or others, are encouraged.
This was the first completeness review under the proposed timeline in a specific case, and the Bureau staff has undertaken to prepare and file this statement for the record describing the meeting. The Applicants made no substantive presentation on the merits to the staff during the meeting.
