AERONAUTICAL FREQUENCY NOTIFICATION APPLIED TO ALL MULTICHANNEL VIDEO PROGRAMMING DISTRIBUTORS (MVPDs)§76.610 exception for non-cable multichannel video programming distributors (MVPDs). (a) Sections 76.605(a)(12), 76.610, 76.611, 76.612, 76.614, 76.1804(a) through (f), 76.616, and 76.617 shall apply to all non-cable MVPDs. (b) To comply with § 76.1804(b), a non-cable MVPD should file form 321 (Aeronautical Frequency Notification (AFN)). Follow this link to read about AFN and Form 321. Sections 76.605(a)(12), 76.610, 76.611, 76.612, 76.614, 76.1803, 76.1804, 76.616, and 76.617 shall apply to all non-cable MVPDs. Exception: Non-cable MVPDs serving less than 1000 subscribers and less than 1000 units do not have to comply with Section 76.1804(g).
RELIEF FOR SMALL NON-CABLE MVPDSAfter carefully considering the comments on the proposed relief for small MVPDs, we adopt a very limited exemption to the annual reporting requirement of 47 CFR § 76.1804(g) of our rules. This exemption will apply to non-cable MVPDs with less than 1000 subscribers or serving less than 1000 units. Such an exemption furthers congressional directives to reduce the regulatory burden on small entities where feasible. We have no reason to believe that such an exemption will affect enforcement of the Commission's signal leakage rules. (Page 35) for more details...
AMENDMENT OF THE COMMISSION'S RULES FOR IMPLEMENTATION OF ITS CABLE OPERATIONS AND LICENSING SYSTEM (COALS)Amendment of the Commission's Rules for Implementation of its Cable Operations And Licensing System (COALS) to Allow for Electronic Filing of Licensing Applications, Forms, Registrations and Notifications in the Multichannel Video and Cable Television Service and the Cable Television Relay Service. 1. This Report and Order revises our rules governing the filing of the majority of forms filed by the public for the Multichannel Video and Cable Television Service ("MVCTS") and applications in the Cable Television Relay Service ("CARS"). In addition to the CARS microwave applications, these forms include cable television operator registrations, change of operational information, cable television system reports, aeronautical frequency usage filings, and annual signal leakage reports. These rule changes facilitate our implementation of the Cable Operations and Licensing System ("COALS") and will allow for a new electronic filing system. This action will reduce the effort for Multichannel Video Programming Distributors ("MVPDs") to file applications, reports, and other documents. It will also enhance the availability to the industry and the public of cable system and multichannel video programming systems information. Signal Leakage Rules applied to MVPDs
Following the adoption of the new Inside Home Wiring Rules,
released October 17, 1997, the Commission decided to apply the cable signal leakage
rules to all non-cable Multichannel Video Programming Distributors (MVPD) that pose a similar
threat of interference with frequencies used for over-the-air communications. The affected MVPDs (Red Boxes) or * and rule sections are:
* At least once each calendar year each Multichannel Video system utilizing aeronautical frequencies must conduct measurements of its signal leakage. A performance report (FCC320), which demonstrates the results of its test, must be filed each calendar year in accordance with 47 C. F. R. Section 76.1804.
