(CS 99-251) Dear Joan: As you know, the Federal Communications Commission adopted on October 8, 1999, and released on October 20, 1999, revised cable horizontal ownership limits and ownership attribution rules. The Horizontal Ownership Limits Third Report and Order clarified that a cable company that serves 20% or more of multichannel video programming distribution (MVPD) subscribers nationwide must certify, concurrent with its application for transfer of licenses, that its proposed acquisition of additional systems will not violate the horizontal ownership limits. As I mentioned in my voicemail message to you last week, AT&T needs to make a showing and certification that its proposed acquisition of MediaOne will fit under the Commission's revised cable ownership rules. We propose that AT&T meet with the Cable Services Bureau staff to discuss these issues the week of November 1, 1999, to be followed by a written submission from AT&T the following week showing how AT&T's proposed acquisition of MediaOne will fit under the revised cable ownership attribution rules and horizontal ownership limits.
