NJ$-xThe single body for certifying communications equipment, and which tests equipment for compatibility with Ukraine's public communications network, is the Communications Technology Certification Body (CTCB) the Authority of Development Strategy and Scientific and Technical Policy (USNTP) of Minsviaz Ukraine. It is accredited in the UkrSEPRO system (Registered NUA 4.001.06 of December 2, 1996) of the Ministry of Posts  N(-and Telecommunications of Ukraine. Equipment must have a certificate granted in accordance with the requirements of the current legislation of Ukraine (Article 25 of the Law of Ukraine "On Communications"). xOperators attach telecommunications equipment to the public network and "Communications operators of all forms of ownership provide their services to consumers in accordance with current legislation, and terms of pertinent licenses and agreements between customers and operators, as well as under the stipulation that the consumer follows the rules for using communications networks and pays for services," (Article 14 of the Law "On Communications"). When equipment is to be attached to the network, a certificate is required. xThere are restrictions on importing uncertified equipment. They are set out in the Customs Code of Ukraine as well as in the lists of products subject to obligatory certification in Ukraine (approved by the orders of Gosstandart of Ukraine). xMatters of customs clearance are outside the scope of the Ministry of Posts and Telecommunications of Ukraine. xMatters of customs clearance are resolved by local customs authorities. xDisputed questions related to customs clearance can be cleared up in the State Customs Committee of Ukraine (Kiev, ul. Politekhnicheskaya, 4a; office telephone 011 380 44 274 81 93). xThe regulatory documents of Minsviaz Ukraine have no restrictions on advertising and marketing uncertified equipment (except matters related to state security and operators' commercial secrets). Uncertified communications equipment is not advertised by departmental mass media. xInformation about standard network termination points for each type of service may be obtained the same way as any other regulatory documents: in the branch research institutes; in test centers and laboratories; in branch scientific and technical libraries; from communications operators; etc.  L%- 4.XxORGANIZATIONAL STRUCTURE AND SCHEME OF CERTIFICATION (# xThe structure of the organization of telecommunications equipment certification in Ukraine is given in Annex 3. "X)0*0*0*+"ԌxThe Communication Technology Certification Body:  N-x` ` receives applications for performing communications equipment certification tests, considers the application and technical documentation for the product, and chooses the certification scheme and test center or laboratory for certifying a given type of equipment,(#`  N-x` ` instructs the relevant test center or laboratory to carry out certification tests of the given products (copies of the instructions are sent to the applicant, and, when necessary, to Gosstandart),(#`  NH -x` ` monitors procedures and test results (reports),(#`  N -x` ` participates in selection of samples,(#`  N -x` ` analyzes test results,(#`  NX-x` ` considers materials and analysis results in the Technical Certification Commission (the TKS, whose members are nominated by order of the Ministry of Posts and Telecommunications),(#`  N-x` ` decides whether or not to grant a certificate (taking into account the TKS decision),(#`  N@-x` ` executes and grants compliance certificates,(#`  N-x` ` monitors product conformance with the granted certificate during its operation, (#`  N-x` ` considers appeals,(#`  NP-x` ` cancels the certificate in appropriate cases, and(#`  N-x` ` keeps the certificate registry. L- 5.XxORDER AND PROCEDURES OF CERTIFICATION(#  Lp-  LH -5.1XxAre there rules and publications that specify application and approval procedures? Information about them can be obtained from the USNTP and the certification test centers or laboratories.  N- xA certificate can be terminated for the following general reasons:  Nz-x` ` expiration of a certificate,(#`  N*-x` ` cancellation of a certificate (upon the decision of the Body as a result of discovered product noncompliance with the certificate (if the manufacturer is not able or does not want to eliminate the noncompliance) or if the manufacturer breaches obligations fixed in the agreement with the Body or its test center.(#` xThe termination of the validity of a certificate is noted in the registry and published. xA certificate is granted for 13 years. Choice of the term is made on a case by case basis, at the discretion of the Body (depending on product type and complexity, quantity of delivered products, and the manufacturing firm's credibility in Ukraine and the world, etc.).  LJ$- 5.2XxWhat organization must the manufacturer contact to begin the certification process?(#  N&- xCTCB (USNTP).  L(- 5.3XxWhat fees are charged for certification and how (on what basis) are they"(0*0*0*0*"  L-established? (# xThere is no charge yet for submitting an application or granting a certificate. (However, payment for them is planned in accordance with the tariffs effective in CTCB.) xThe applicant pays certification test expenses under the agreement or contract concluded between the applicant and the test center (irrespective of the test results). The amount of payment is negotiated in the contract.  N-  L- 5.4XxIs there a standardized form that must accompany a certification request? LX- 5.5XxWhat other information must be filed, such as a test report, photographs,  L0-technical description, technical specifications, and in what language? (# xThe applicant must file technical documentation that is necessary and sufficient to identify a product unambiguously. This documentation must contain enough information about the product's features to make it possible for CTCB to make a decision about the products submitted for certification.  N@- xDomestic manufacturers and manufacturers from the countries of the Commonwealth of Independent States must file copies of technical specifications, a technical description, and an operations manual (these documents may be combined into one document). CTCB determines whether or not a foreign applicant's documentation (specifications, versions, users' manuals, service instructions, etc.) is sufficient. xThe applicant should file as many different documents as possible (prospects, production and line test reports, product certificates and materials on product certification tests from other countries, etc.) so as, in the applicant's opinion, to permit identification of product features and to facilitate certification. xThe state language of Ukraine, Ukrainian, is to be used in technical documentation (in line with p. 5.15 of KND 5000293). Foreign manufacturers may file technical documentation in the English or Russian language (at the discretion of CTCB). If documents are submitted in English, certification fees will be somewhat higher due to translation costs paid by the test laboratory or CTCB.  Lp#- 5.6XxIs the applicant required to submit a sample of the equipment for testing? (# xIt is obligatory. CTCB considers this request, taking into account the presented materials on the operating and monitoring the product during the validity period of the certificate (when necessary, additional tests may be required) and makes a decision. If the decision is favorable, the certificate is extended, and the date indicated in the certificate is changed or a new certificate is issued through established procedures. The extension is registered.  L- 5.8XxHow long does it normally take to process an application, to perform tests, to  Lp-issue a certificate? Describe causes of delays in the certification process. (#  NH - xIt normally takes 12 weeks for an application to be considered by CTCB (according to p. 5.14 of KND 5000593, it may take up to one month from the date of registering an application). xThere is no fixed term by which the tests must be performed (it depends on the complexity of the product and its peculiarities, submitted documentation, time spent to conclude the contract between the applicant and the test laboratory, etc.).
