L- 2.xLEGISLATIVE BASE (LEGAL BASIS) OF CERTIFICATION  Nx-x The telecommunications equipment certification system in the Republic of Moldova is at the stage of development and introduction. xThe person responsible for telecommunications equipment certification in the Ministry of Communications and Informatics is Mr. Ion Coshuleanu, Director of the General Directorate for Regulations, tel: 011 7 373 2 24 05 75, fax: 011 7 373 2 24 15 53. xThe list of the main legislative acts regulating telecommunications equipment certification includes Laws of the Republic of Moldova:  N -x` ` "On Protection of Consumers' Rights," "On Telecommunications," "On Restrictions on Monopolistic Activities and Development of Competition;"(#`  Np#-x` ` Decree of the Government No. 414, "On the Conduct of Certification of Products in the Republic of Moldova."(#` xCompleting development of the telecommunications equipment certification system and beginning its introduction is planned for January 1, 1997. At the moment the Provisional Procedure for Certification of Telecommunications Terminal Equipment Certification is functioning (see point 5.7). "X)0*0*0*+"ԌxFor telecommunications equipment of other countries, a certificate granted in accordance with the current legislation of the Republic of Moldova is required. xApplication of other countries' certificates is not allowed in the Republic of Moldova.  L8- 3.XxMINISTERIAL ACTS DEFINING CERTIFICATION OF TELECOMMUNICATIONS  L-EQUIPMENT (#  N- x At the present time, there are adopted and effective:  Np-x` ` "Concepts of Standardization and Certification in Telecommunications and Informatics," approved by the Board of the Ministry of Communications and Informatics on March 9, 1995;(#`  N -x` ` "Provisional Procedure for Certification in Telecommunications and Informatics," approved by the Board of the Ministry of Communications and Informatics on May 16, 1996 and agreed upon with the Department of Standardization and Metrology of the Republic of Moldova.(#` xEquipment connected to the public network must have a type approval (certificate) or an individual permit for utilization. An operator has the right to choose the equipment to be connected to the network. xIn the Republic of Moldova there are restrictions on import of uncertified equipment. They are set out in the Provisions on Import and in Governmental Decree No. 414, "On the Conduct of Certification of Products in the Republic of Moldova." xAccording to the Law "On Telecommunications," vendors of telecommunications equipment must have type approval for the given type of equipment. This type approval is granted by the Ministry of Communications and Informatics. The Law "On Telecommunications" is published in Monitorul Oficial No. 6465 of November 8, 1995.  L- 4.XxSTRUCTURE AND ORGANIZATIONS SCHEDULE FOR CERTIFICATION OF  L-TECHNICAL COMMUNICATIONS EQUIPMENT(#  N-x It is simple and described in the text of the present material. (# xA certification procedure is under development. xAt present, the "Provisional Procedure for Certification of Technical Telecommunications Equipment" is effective. Its objective is to permit the sale and supply of telecommunications equipment while the telecommunications equipment certification system is put into operation. xIn accordance with the Law "On Telecommunications," telecommunications equipment can be sold or supplied only if a type approval granted by the Ministry of Communications and Informatics is available. xAn applicant that has a certificate granted by the Ministry of Posts and Telecommunications of the Russian Federation or a type approval granted by the Communications Ministry of Romania submits it to the General Directorate for Regulations of the Ministry of Communications and Informatics of the Republic of Moldova accompanied by the standardized application form. The applicant submits technical documentation and samples to the State Radio Frequency Inspectorate for radio equipment certification and to Moldtelekom for telecommunications equipment certification. The applicant concludes a contract with the body for carrying out the analysis (in this case, the State Radio Frequency"X)0*0*0*+" Inspectorate or Moldtelecom). xAfter analysis of the certified equipment for compliance with the standards of the Republic of Moldova, tests are performed only for those parameters that do not conform with these standards. xTechnical analysis is carried out within 30 days. xIf the results are favorable, the body that carries out the analysis issues a certificate. The Commission on License Grants of the Ministry of Communications and Informatics considers the application and the granted certificate and makes a decision to grant a type approval.
