Mx- 2.xLEGISLATIVE BASE (LEGAL BASIS) OF CERTIFICATION  M(- xIn the Lithuanian Republic, the telecommunications equipment certification system is developed and effective. Tel: 011 370 2 261 117, 011 370 2 261 312; fax: 011 370 2 261 564. xWhen exporting and importing telecommunications equipment that does not radiate/receive electromagnetic emissions (telephone sets, etc.), no procedures related to certification are applied and no certificates are required to be submitted to the Customs Authorities. xWhen exporting and importing telecommunications equipment that radiates/receives electromagnetic emissions (radio stations, cordless telephones, etc.), a supplier must obtain a permit to import or export the telecommunications equipment, which must be presented to the Customs Authorities. The permit is granted by the State Radio Frequency Service, at a fixed charge.  M - 3.XxMINISTERIAL ACTS DEFINING ATTACHMENT OF TELECOMMUNICATIONS EQUIPMENT TO THE NETWORK(#  M- xThe main ministerial acts are listed below:  M-x` ` Decree of the Government of the Lithuanian Republic No. 949, "On the Procedures for Import of Radioelectronic and Electrical Equipment, Its Manufacture, Use and Sale in the Territory of the Lithuanian Republic" (of December 15, 1992);(#`  M-x` ` Order of the Ministry of Communications and Informatics of the Lithuanian Republic (of December 4, 1995, No. 93), "On the Procedures of Certification of Radio and Terminal Equipment of the Public Telephone and Telegraph Network," that approves:(#`  M(-x` `  "Rules of Mounting, Installation and Operation of Radioelectronic Equipment and Cable Television Devices. Part 2. (# xA network operator must allow attachment of telecommunications equipment to the public network if a certificate granted by the State Radio Frequency Service is present. xImported telecommunications equipment must comply with the technical requirements established in the Lithuanian Republic. Requirements on import are specified in Decree of the Government of the Lithuanian Republic No. 949, "On the Procedures for Import of Radioelectronic and Electrical Equipment, Its Manufacture, Use and Sale in the Territory of the Lithuanian Republic" (of December 15, 1992). xIn some cases it is possible to import equipment before it has received a certificate: import of equipment in limited quantities for certification tests, import of equipment in limited quantities for display at exhibitions, import of equipment solely for export, import and manufacture of equipment to be used by the Ministry of Internal Affairs and the Ministry of Regional Protection, and by other special services. xRestrictions on import are available to suppliers. This is the Order of the Ministry of Communications and Informatics of the Lithuanian Republic (of December 4, 1995, No. 93), "On the Procedures of Certification of Radio and Terminal Equipment of the Public Telephone and Telegraph Network." xA manufacturer or supplier may obtain additional information from the State Radio Frequency Service. xAdvertising and sale of uncertified equipment are prohibited. This is established in the Law On Protection of Consumers' Rights of the Lithuanian Republic (of November 10, 1994, No. I657) and in Decree of the Government of the Lithuanian Republic No. 949, "On the Procedures for Import of Radioelectronic and Electrical Equipment, Its Manufacture, Use and Sale in the Territory of the Lithuanian Republic" (of December 15, 1992). xThere are standard network termination points for attachment of wireline terminal equipment to the public switched telephone network. The standard network termination point is a point of demarcation and/or interconnection between communications facilities of the State telephone company and wireline communications terminal equipment. For other services such a point is not defined. Additional information about network termination points may be obtained from the State Radio Frequency Service.  M - 4.XxSTRUCTURE AND ORGANIZATIONAL SCHEME FOR CERTIFICATION OF  M -TECHNICAL COMMUNICATIONS EQUIPMENT (#  M"- x Telecommunications equipment certification is within the purview of the State Radio Frequency Service, which is an enterprise of the Ministry of Communications and Informatics of the Lithuanian Republic. Therefore the structure and organizational scheme for certification of technical communications equipment is simple. xThe State Radio Frequency Service (with expert groups on certification) receives applications for certification of equipment, and a test laboratory of the State Radio Frequency Service measures its parameters and forwards the test reports to a certification expert, who makes a decision whether or not to grant the compliance certificate."X)0*0*0*+"Ԍ M-ԙ 5.XxORDER AND PROCEDURE OF CERTIFICATION(#  M- 5.1Xx Are there rules and publications that specify the application and approval procedures? If yes, how can applicants obtain copies of these rules and publications? Describe the procedures for terminating a certificate and reasons for which a certificate would be terminated. Certification of Radio and Terminal Equipment of the Public Telephone and Telegraph Network." xThe Order of the Ministry of Communications and Informatics of the Lithuanian Republic was published in the official magazine "Valstybes inios" No. 106 of December 29, 1995. xThe Inspection Authority (Inspection Department of the State Radio Frequency Service) registers certified equipment, issues a mark of conformity, supervises the correct use of the certificate and the mark of conformity, and takes test samples of serial equipment from the stores or from manufacturers for monitoring. In case of nonconformity of the equipment parameters to the standards or the wrongful use of a certificate and mark of conformity, the certification body may cancel the certificate. The decision to terminate a certificate is taken by the certification body. xThe term of validity of a certificate is three years.  MP- 5.2XxWhat organization must the manufacturer contact to begin the certification process?(#  M(- xThe State Radio Frequency Service.  M- 5.3XxWhat fees are charged for certification and how (on what basis) are they established?(#  M- xThe fee for consideration of the application, the test report, adoption of a decision and issuance of the certificate depends on the type of equipment and may be $50500. The payment is based on recovering the abovementioned expenses.  M!- 5.4XxIs there a standardized form that must accompany a certification request? If yes, please attach a copy of the form.(#  Mp#- xYes. The application requesting certification on a standard form is submitted with a declaration that is different for each type of equipment. The application contains information about the manufacturer (supplier) of the equipment, operational modes, electrical parameters, composition, and conditions of equipment testing.  M(- 5.5XxWhat other information must be filed, such as a test report, photographs, technical descriptions, and in what language?(#"X)0*0*0*+"Ԍ M- ęxBesides the information indicated in point 5.4, the main parameters of the equipment, declared by the manufacturer, a technical description of its maintenance (with a schematic diagram of the circuitry), an operations manual, copies (if available) of foreign test reports and certificates, and a copy of the certificate (if available) granted to the equipment manufacturer in accordance with the ISO 9001 standard are to be submitted. xThe operations manual must be in the Lithuanian language, other documents may be in the Lithuanian, English or Russian language. x  M- 5.6XxIs the applicant required to submit a sample of the equipment for testing? (# xYes.  M - 5.7XxPlease describe how applications are processed from submittal to grant of certification. What procedures exist for enforcement of the terms of the certificate? What procedures exist to prolong the certificate's validity?(#  M - xThe applicant submits the application, the declaration and other necessary material to the certification expert for consideration. If the material is found deficient, the expert contacts the applicant to obtain additional information. A response to the application requesting certification and an instruction to the test laboratory is sent to the applicant within seven days. After that, the declaration materials and equipment submitted by the applicant are sent to the test laboratory Upon completion of the tests the laboratory forwards the test reports to the expert who reviews them to determine compliance of the measured parameters with those established in the standard. In the event of a favorable decision, a certificate of conformity is granted. A copy of the certificate is forwarded to the Inspection Authority. If the application is denied, the expert sends the applicant a written decision, and the applicant must modify the equipment and begin the certification procedure again. xThe Inspection Authority registers the certified equipment, issues a mark of conformity, supervises the correct use of the certificate and the mark of conformity, takes samples of equipment from the stores or from the manufacturer for monitoring tests. If the equipment parameters do not comply with the standards, the certification body may cancel the certificate. xThe validity of a certificate is extended by the decision of the certification body without additional laboratory tests if the annual monitoring tests did not show any nonconformity with the standards, the certificate and mark of conformity were used correctly, etc. In this case, the owner of the certificate files an appropriate application with the certification body and pays the certification expenses.  M!- 5.8XxHow long does it normally take for an application to be processed and granted? (#  M"- xTo process an application 7 days, to perform tests 34 weeks, to issue a certificate 7 days. xDelays arise if information about the equipment is incomplete or the equipment to be tested is set improperly, or there are no relevant statements about conformity, etc.  M(- 5.9XxWho can an applicant contact to find out the status of an application while it is being  MX)-processed? An applicant may appeal a denial to the Ministry of Communications and Informatics of the Lithuanian Republic within 10 days after receiving the decision. xDelays in processing an application are resolved without the need for a formal appeal.  M - 5.11XxHow can a manufacturer learn what standards, and testing programs and  M -methodologies, a product must meet to obtain certification? (# xThe technical requirements, and test programs and methods, with which equipment must comply to receive a certification, may be obtained from the State Radio Frequency Service.  M- 5.12XxHow can manufacturers obtain copies of the standards, technical requirements, testing programs and methodologies?(#  Mh- xRequests for the requisite equipment need to be sent to the State Radio Frequency Service. The manufacturer will receive an invoice and, after payment, will receive the requested documents.  M- 5.13XxCan manufacturers participate in development of the standards? How? (# xYes. The process of developing standards is open and all interested parties can participate in it.  M- 5.14XxDoes a test laboratory need to be recognized or accredited by the certification agency or some other party before its test data can be accepted by the certification agency?
