XxX` ` The order establishes that all types of technical devices intended for use in the communications and informatics public networks and in networks interacting with them are subject to obligatory certification within the framework of the sectoral certification system established by the Ministry of Posts, Telecommunications and Informatics. All economic entities' telecommunications certificates issuing is based on the accredited laboratories test results. Institute Giprosviaz is designated by Order No. 78 as the head organization of the sectoral certification system that is entrusted with certifying communications and informatics equipment. .`  N-x` `  "Introduction of Obligatory Certification of Consumer Goods, Works and Services," No. 142 of 10/30/93.. x` ` The order states that, to protect peoples' health and life, and the environment, and to remove barriers to developing interstate trade, the Council of Ministers of the Republic of Belarus, by decree No. 635 of 9/22/93,"xxx" introduced, starting January 1, 1994, obligatory certification of consumer goods, works and services, for which safety requirements for peoples' health, life and properties, and environment are appointed by regulatory documents and the legislation of the Republic of Belarus. This decree fixes safety requirements for peoples' life, health, and property, and for the environment, in the legislation of the Republic of Belarus and in regulatory documents. As of April 15, 1994 it is prohibited to sell goods subject to obligatory certification without a compliance certificate granted by the Committee on Standardization, Metrology and Certification (Belstandart), attached to the Council of Ministers of the Republic of Belarus or, at its instruction, by the Certification Body, Giprosviaz. If these requirements are violated, officials of the Committee on Standardization, Metrology and Certification issue an order prohibiting production and sale of those products and also fine the violator in the amount of the cost of the products sold. Because communications and informatics equipment are subject to obligatory certification in the Republic of Belarus (Order No. 78 of 9/30/92), Order No. 142 establishes the need to  NH -strengthen control over attaching technical devices having compliance certificates to t he public communications networks..`  N -x2.` ` Resolution of the Board of the Ministry of Posts, Telecommunications and Informatics, "On the Principles of Interaction of the Ministry of Posts, Telecommunications and Informatics and Belstandart in the Sphere of Certification," No. 161/11 of April 29, 1993..` x` ` This Resolution states that Belstandart recognizes the existing communications and informatics equipment certification system with its development into a subsystem in the National Certification System; Belstandart delegates to the Institute Giprosviaz the functions and powers of a communications and informatics Certification Body in the National Certification System of the Republic of Belarus. Institute Giprosviaz thus has the right to grant certificates when these certificates are signed by the Minister of Posts, Telecommunications and Informatics and by the Chief of the Certification Body, Giprosviaz..` xAt present, there are no restrictions on importing telecommunications equipment before it has received a certificate, except for importing radio equipment. Authorization of the State Telecommunications Inspectorate (BelGIE) of the Ministry of Posts, Telecommunications and Informatics of the Republic of Belarus must be submitted to the customs authorities in order to import radio equipment. xThere are no restrictions on importing prototypes to be tested and assembled incountry. xAt present, questions concerning restrictions on importing without a certificate are being considered by the State Telecommunications Inspectorate (BelGIE) and the customs service. xRestrictions on importing radio devices are published. Documents on import restrictions are under the jurisdiction of the"xxx" State Telecommunications Inspectorate. xRequests should be addressed to the State Telecommunications Inspectorate, ul. Accepting other countries' certificates in place of certificates of the Republic of Belarus is not allowed. xRestrictions on telecommunications equipment certification are set out in Council of Ministers Resolution No. 635, which was published in periodicals as well as in informational documents of the Council of Ministers. Applicants may purchase the text of the Resolution from the Institute Giprosviaz. xThere are standard network termination points for each type of service; requirements for these are set out in the regulatory documents (State standards and others). Manufacturers may obtain information from the Institute Giprosviaz.  L- 4.XxSTRUCTURE AND ORGANIZATIONAL SCHEME FOR CERTIFICATION OF TELECOMMUNICATIONS EQUIPMENT. x  N@-x The structure is given in the figure in Annex 1. xThe Certification Body for communications and informatics equipment, Giprosviaz, receives applications for telecommunications equipment certification, examines applications and technical documentation for telecommunications equipment, analyzes regulatory documents and information about equipment quality, and chooses the certification procedures and test laboratories. After concluding an agreement with the applicant, Giprosviaz develops a program of certification tests, submits it for approval to the Ministry of Posts, Telecommunications and Informatics, and forwards it to the accredited test laboratory (AIL). xThe accredited test laboratory performs the certification tests according to this program and forwards the test reports to Giprosviaz, which analyzes the test results and makes the decision whether or not to grant a compliance certificate. This decision submitted for approval to the Ministry of Posts, Telecommunications and Informatics. Giprosviaz processes the"xxx" certificate, gets it approved in the Ministry of Posts, Telecommunications and Informatics, and registers it in the Registry of the National Certification System of the Republic of Belarus.  L- 5.XxORDER AND PROCEDURE OF CERTIFICATION.  L8- 5.1XxAre there rules and publications that specify the application and approval procedures? If yes, how can applicants obtain copies of these rules and publications? Describe the procedures for terminating a certificate and reasons for which a certificate would be terminated. The Certification Body, Giprosviaz, may decide not to suspend a certificate when an applicant is able, during a fixed period, to find points of noncompliance, to show corrective measures being taken, and to confirm product compliance with the regulatory documentation. If this cannot be done, the certificate is cancelled and the product is taken off the Registry of the National Certification System. xAccording to Guideline Document 5.00692 of the National Certification System, a certificate is granted for a period of one to three years, depending on the choice of certification scheme.
