                     NOTICE OF VIOLATION


                                   Released:  February 23, 
2005

By the District Director, Kansas City Office, South Central 
Region, Enforcement Bureau:

   1.     This is a Notice of Violation ("Notice") issued 
     pursuant to Section 1.89 of the Commission's Rules,1 to 
     Maria L. Salazar, licensee of radio station KTCM.

   2.     On February 16, 2005, an agent of the Commission's 
     Kansas City Office attempted an inspection of radio 
     station KTCM  located in Kingman, Kansas, and observed 
     the following violation(s):

   2.a.      47 C.F.R.  73.1125: ``Each FM broadcast 
             station shall maintain a main studio.''  
             The Commission has determined that this 
             includes maintaining a full-time 
             managerial and non-managerial presence 
             during normal business hours.  This also 
             includes providing access to the station's 
             public inspection file during normal 
             business hours.  Normal business hours are 
             typically an 8-hour period between 8:00 
             a.m. and 6:00 p.m. local time Monday 
             through Friday.

             At the time of the attempted inspection, 
             2:00 p.m., the studio door was locked, no 
             person was present, and no business hours 
             were found posted.  The station manager, 
             via telephone, stated that no person was 
             on duty at the station's studio after 
             12:00 p.m. (Noon) on Wednesdays, Thursdays 
             or Fridays. 

   2.b.      47 C.F.R.  73.1225: ``The licensee of a 
             broadcast station shall make the station 
             available for inspection by 
             representatives of the FCC during the 
             station's business hours, or at any time 
             it is in operation.''  

             At the time of the attempted inspection of 
             the station, no person was present at the 
             station, or available to allow an 
             inspection.  The station manager was 
             contacted by telephone at his location in 
             Wichita, Kansas, approximately 60 miles 
             distance from Kingman, Kansas.  The 
             manager stated that the sole station 
             operator in Kingman had normal hours of 
             8:00 a.m. to 5:00 p.m. on Mondays and 
             Tuesdays, and from 8:00 a.m. to Noon on 
             Wednesdays, Thursdays and Fridays.  

   3.     Pursuant to Section 308(b) of the Communications 
     Act of 1934, as amended,2 and Section 1.89 of the 
     Commission's Rules, Maria L. Salazar, must submit a 
     written statement concerning this matter within twenty 
     (20) days of release of this Notice.  The response must 
     fully explain each violation, must contain a statement 
     of the specific action(s) taken to correct each 
     violation and preclude recurrence, and should include a 
     time line for completion of pending corrective 
     action(s).  The response must be complete in itself and 
     signed by a principal or officer of the licensee.  All 
     replies and documentation sent in response to this 
     Notice should be marked with the File No. and NOV No. 
     specified above, and mailed to the following address:

   4.     This Notice shall be sent to Maria L. Salazar at 
     the address of record.

   5.     The Privacy Act of 19743 requires that we advise 
     you that the Commission will use all relevant material 
     information before it, including any information 
     disclosed in your reply, to determine what, if any, 
     enforcement action is required to ensure compliance.  
     Any false statement made knowingly and willfully in 
     reply to this Notice is punishable by fine or 
     imprisonment under Title 18 of the U.S. Code.4
