Subject: Amateur Radio License AH8I: Warning Notice, Case #EB-2007-2996
Dear Mr. Severa:
On March 1, 2007, we forwarded to your address of record in Pago Pago a
complaint regarding out of band operation. The letter was returned
unclaimed, as was a letter sent to the address of the DX Society of
California in Folsom, CA, for which you were listed as the trustee; and a
letter sent to your address in Juneau, AK, another address listed for the
American Samoa DX Society of California.
Finally a letter was sent to you at the Chico, CA address on March 27,
2008, and you replied by letter dated April 25, 2008. In that letter you
stated that you had operated out of band because it was "dark in the
vehicle and apparently I experienced a problem with improper VFO selection
of the transceiver that I was using which caused me to transmit out of
band." You did not explain why you failed to respond to mail sent to your
address of record.
Please be advised that future instances of out of band operation will
result in enforcement action against your license. Additionally, you are
requested to update your license records within 10 days indicating ad
address at which you will receive Commission mail. Failure to respond to
Commission mail sent to your address of record is a separate violation of
Commission rules.
