In this Order we grant, subject to certain limitations outlined below, applications for authorization filed by the public safety agencies listed in the attached Appendix to deploy and operate the surveillance robot known as the “Recon Scout” for public safety purposes.1 The Recon Scout is a remote- controlled, maneuverable surveillance robot manufactured by ReconRobotics, Inc. (ReconRobotics), which transmits real-time video surveillance data.2 In granting the applications, we deny the Petition to Deny Applications filed against each of the subject applications by the ARRL, the national association for Amateur Radio (ARRL), the series of pleadings entitled Petition to Deny Applications/Conditional Authority and First Amended Petition to Deny, which Mr. James Edwin Whedbee (Whedbee) filed against these applications, as well as all associated challenges filed in related pleadings against these applications.3 II. BACKGROUND 2. The Recon Scout is designed to operate in the 420-450 MHz band at 1-watt peak power. Federal Communications Commission DA 12-123 2 operate in this band.5 Specifically, ReconRobotics sought a waiver of Sections 90.101, 90.207, and 90.209 of the rules,6 to (1) permit equipment authorization for the Recon Scout and (2) enable public safety customers to obtain licenses for use of the Recon Scout. On February 23, 2010, the Public Safety and Homeland Security Bureau (PSHSB) and the Wireless Telecommunications Bureau (WTB) jointly released an Order (Waiver Order) granting the requested relief, subject to the following conditions applicable to applicants seeking licenses to operate the Recon Scout: · Eligibility is limited to state and local police and firefighters eligible for licensing under Section 90.20(a)(1) of the Commission’s rules and security personnel in critical infrastructure industries. No operation is permitted prior to license grant, and no applications will be granted until ReconRobotics obtains equipment authorization. · When applying for authorization to operate the Recon Scout, the applicant must reference the Waiver Order by DA 10-291, and specify the proposed area of operation and the requested frequency segment. · The Recon Scout may be used only during actual emergencies involving threats to safety of life and for necessary training related to such operations. Security personnel in critical infrastructure industries may operate the Recon Scout only in areas that are environmentally hazardous for entry by human personnel, and for necessary training related to such operations. · Training operations are not permitted within thirty kilometers of certain Federal radiolocation sites, as listed in the Waiver Order. · The Recon Scout will operate on a secondary basis (cannot cause interference and is not protected from interference) to all Federal users and licensed non-Federal users. · The operation of the Recon Scout may be affected by certain radar and ionospheric research sites, as listed in the Waiver Order. · Licensees must maintain a log of all Recon Scout use. The log will include the date of operation, start/stop times, location of operation, frequency segment of operation, reason for use, and point of contact. Licensees must provide this information to the Commission or to the National Telecommunications and Information Administration upon request of either agency.7 3. In March 2010, ARRL, Kristopher Kirby, and W. Federal Communications Commission DA 12-123 3 denying it in part, denying the Kirby and McVey Petitions, and dismissing Whedbee’s motion.10 The Order on Reconsideration partially granted ARRL’s petition by amending the labeling and instruction manual requirements for the Recon Scout.11 4. After release of the Waiver Order and certification of the Recon Scout equipment,12 the public safety agencies listed in the Appendix applied for licenses to operate Recon Scout units under the conditions specified in the Waiver Order. ARRL and Whedbee filed petitions to deny each of these applications.13 The public safety agencies subsequently amended their applications to narrow the frequency range specified in the applications, and Whedbee filed amended petitions to deny against each amended application.14 For the sake of regulatory efficiency, we are treating the amended applications as the pending applications on which we will act, consistent with their status in ULS. ReconRobotics opposed the Whedbee and ARRL petitions, arguing that they represented a collateral attack on the Waiver Order and raised no new issues that had not been considered in that proceeding.15 None of the applicants filed responses to the Whedbee or ARRL petitions. We now consider the pending applications and associated petitions. III. DISCUSSION 5. As noted above, the Waiver Order granted a waiver to permit licensing and operation of the Recon Scout pursuant to the Commission’s Part 90 and other rules, subject to a number of conditions specified in the order.16 Among these conditions, applicants must reference the Waiver Order in their applications and must specify the proposed area of operation and the requested frequency segment.17 On their face, all of the applications listed in the Appendix comply with these requirements. Since all of Whedbee’s pleadings raise essentially the same arguments, we find that considering them collectively will not prejudice the proceeding. ReconRobotics also argues that neither Whedbee nor ARRL has standing to challenge the applications. ReconRobotics Opposition to Petitions to Deny at 3-4. Subsequently, Whedbee argued that ReconRobotics lacks standing to participate in the application process. Whedbee First Amended Petition to Deny Applications for License at 6. Similarly, Whedbee filed a document styled an “Informal Request to Strike Opposition” in Application No. 0004323989, Berrien County Emergency Management, and Application No. 0004331004, Lafayette Police Department, seeking to strike the oppositions filed by ReconRobotics for want of standing. Section 1.41 of the Commission’s rules does not require a petitioner to demonstrate standing to file an informal objection. 47 C.F.R. § 1.41. See Nextel License Holdings 4, Inc., Order, 17 FCC Rcd 7028, 7033 ¶ 16 (WTB CWD 2002); National Science and Technology Network, Inc., Order on Further Reconsideration, 17 FCC Rcd 11133, 11135-36 ¶ 5 (WTB PSPWD 2002). For similar reasons, we decline Federal Communications Commission DA 12-123 4 A. Collateral Attacks on the Waiver Order and Order on Reconsideration 6. In the Waiver Order, WTB and PSHSB granted a waiver establishing the specific conditions (including an application process) under which applicants could obtain licenses for operation of the Recon Scout pursuant to the Act and the Commission’s Rules.19 Subsequently, the Order on Reconsideration retroactively granted a waiver of the allocation table for the 420-450 MHz band.20 In their petitions, Whedbee and ARRL assert that the applications are defective because the 420-450 MHz band is not allocated for use by Public Safety land mobile services.21 Whedbee also argues that the Waiver Order is invalid because the Commission should have resolved this question via a rulemaking proceeding as opposed to waiver and that the Bureaus violated the Administrative Procedure Act in adopting the Waiver Order.22 7. Whedbee and ARRL assert that the objections to the Waiver Order contained in their respective petitions are not collateral attacks on the Waiver Order but rather are challenges to the applicants’ inappropriate reliance on that order.23 Whedbee also argues that the application proceeding is an appropriate place to raise concerns that were raised in the waiver proceeding in order to preserve the objections in the event the applications survive the reconsideration.24 8. We find that the Waiver Order and the Order on Reconsideration fully addressed and decided these arguments raised by Whedbee and ARRL in their petitions. The Order on Reconsideration retroactively waived the applicable provisions of section 2.106 to the extent necessary to permit use of the Recon Scout. We therefore find that Whedbee’s and ARRL’s argument with respect to the allocation issue is moot.25 The Waiver Order and Order on Reconsideration also rejected the argument that the Commission should have acted via a rulemaking proceeding as opposed to waiver.26 Therefore, petitioners no longer have any basis for “preserving” these objections and there is no need to re-address these arguments in the context of the individual applications at issue in this order. B. Additional Contentions of Petitioners 9. Alleged Application Defects. Federal Communications Commission DA 12-123 5 · The Waiver Order granted relief solely to ReconRobotics and ReconRobotics cannot transfer this relief to third parties.27 · The Recon Scout operates in a mobile itinerant manner and the applications do not seek authorization for mobile itinerant operations.28 · The applicants did not frequency-coordinate the applications.29 With respect to Whedbee’s first argument, the Waiver Order‘s grant of relief was not limited to ReconRobotics; rather, it explicitly stated that the waiver was granted to “permit equipment authorization and customer licensing of the Recon Scout.”30 Moreover, the Waiver Order explicitly stated that state and local police and firefighters eligible for licensing under Section 90.20(a)(1) of the Commission’s rules and security personnel in critical infrastructure industries were eligible for authorization to operate the Recon Scout and set forth in detail the application procedures to be used by eligible applicants.31 10. With respect to the arguments that the applicants should have sought authorization for mobile itinerant operations and frequency-coordinated their applications, none of these steps is required by the Waiver Order or the Order on Reconsideration, which established the conditions to permit authorization and customer licensing of the Recon Scout device. The Waiver Order specifically stated that when applying, applicants should reference the Waiver Order and provide information regarding the proposed area of operation and the requested frequency segment.32 In light of these restrictions, we conclude that there is no reason to require applicants to apply for mobile itinerant authorizations. The Commission’s rules define “itinerant operation” as “[o]peration of a radio station at unspecified locations for varying lengths of time.”33 However, the authorizations being granted by this order subject the licensees to the same or greater geographic restrictions than would be associated with mobile itinerant use, because they are limited to operating within a specified radius around a geographic point. In addition, use is further restricted because the licensees may only operate the Recon Scout during actual emergencies involving threats to safety of life or for necessary training related to such operations.34 11. As noted above, the 420-450 MHz band is allocated primarily for Federal use, and non- Federal applicants seeking to operate in Federal bands need not engage in frequency coordination with Federal users because the Commission coordinates such applications with NTIA. Accordingly, the Waiver Order stated that applications would not need frequency coordination,35 and we see no reason to reverse course and impose additional procedural requirements on applicants in light of the strict limitations on use of the Recon Scout that we have already imposed in the Waiver Order and that we apply to the authorizations granted by this order. 12. Public Safety Use. Federal Communications Commission DA 12-123 6 represents itself as a state, county, or municipality . . . are fatally defective” because they are “too broad in scope to ensure that the devices underlying the applications are only put to law enforcement purposes.”36 We do not find any of the applications to be defective on this basis. First, as stated in the Waiver Order, eligibility for authorization to operate the Recon Scout is not limited to law enforcement but also includes firefighters and critical infrastructure security personnel.37 Second, neither the Commission’s rules nor the Waiver Order prohibits a state, county, or municipal government from filing on behalf of an eligible law enforcement or firefighting agency operating under its jurisdiction. As required by the Waiver Order,38 each applicant has specifically referenced the Waiver Order in its application. We consider this to be a representation and acknowledgement that the applicant only seeks authorization for use of the Recon Scout by eligible police and firefighting personnel subject to the limitations set forth in the Waiver Order. Whedbee has not presented any facts to suggest that any state, county, or municipal applicant has sought to make the Recon Scout available to ineligible users. 13. Authorized Bandwidth. ARRL and Whedbee assert that the bandwidth specifications in the applications are inconsistent with the bandwidth provisions in the Waiver Order because the applications request authorization to operate in the 433-445 MHz band segment, whereas the Waiver Order identified three contiguous six megahertz band segments, 430-436 MHz, 436-442 MHz, and 442- 448 MHz, for use by the Recon Scout.39 We find this argument to be moot because the applicants amended their applications to specify the 436-442 MHz band segment in conformance with the designation in the Waiver Order.40 14. ARRL also contends that the applications are defective on the grounds that they are based upon a faulty equipment authorization.41 ARRL notes that the equipment certification for the Recon Scout cited in the applications specifies an emission designator that only authorizes use of 100 kilohertz bandwidth, whereas the Recon Scout was described in the Waiver Order as using six megahertz bandwidth for video transmission.42 ARRL argues that this means either that: (1) the Recon Scout referenced in the certification is not covered by the Waiver Order; or (2) the certification contains an incorrect emission designator, which invalidates the equipment authorization.43 ARRL argues that we cannot grant the applications under either scenario.44 36 Amended Petition at 7. 37 Waiver Order at ¶ 13. 38 See Waiver Order at ¶ 13. 39 ARRL Petition at 5-6. 40 See e.g. File No 0004270113 Application of City of Salina, Kansas. It is true, as ReconRobotics acknowledges, that the Recon Scout device that will be initially provided to public safety entities will not use the full six megahertz video channel but will operate on narrower bandwidth.45 In specifying the device's technical characteristics, however, the Bureaus did not require that the devices operate across the entire six megahertz channel. Rather, so long as the operations are kept within the channel (and otherwise comply with the Waiver Order’s technical conditions), the waiver allows certification of the device.46 Thus, the Waiver Order did not preclude ReconRobotics from obtaining an equipment authorization for a device that uses narrower bandwidth within the six megahertz band segments identified by the Waiver Order. 47 Similarly, nothing in the Waiver Order precludes applicants from obtaining an authorization to use such a device, provided that they operate the device in a manner consistent with both the equipment authorization and the Waiver Order.48 16. Application of Amateur Rules to Recon Scout Operations. Whedbee argues that we should require public safety applicants using the Recon Scout to operate as licensed Amateurs under the procedures established in WP Dockets 10-54 and 10-72.49 These dockets established conditions under which licensed Amateurs employed by public safety entities can participate in drills and exercises on behalf of these agencies. They have no relevance to this proceeding and are not intended to extend the Amateur radio service rules to operations by non-Amateur licensees. 17. Interference to Amateur Station N0ECN. Whedbee argues that we must deny the Johnson County application because it could cause interference to his Amateur station (Station N0ECN) operating in the 430-448 MHz band.50 In the Waiver Order, WTB, PSHSB, and OET concluded that operation of the Recon Scout under the limited circumstances authorized by the order is not likely to cause interference to other licensees, including Amateur stations.51 Moreover, the Waiver Order required operation of the Recon Scout on a secondary basis to other users in the band, meaning that such 45 ReconRobotics Opposition to Petitions to Deny at 5. Federal Communications Commission DA 12-123 8 operations cannot cause interference to and must accept interference from other users.52 The Bureaus upheld this determination in the Order on Reconsideration.53 Whedbee offered no new facts indicating that grant of these applications would create a risk of interference to Amateur Station N0ECN different from the risks evaluated and addressed in the Waiver Order and the Order on Reconsideration. We therefore find Whedbee’s arguments on this point unpersuasive. 18. Petitions for Declaratory Ruling. Whedbee filed a pleading styled as a “Petition for Declaratory Ruling” against each of the amended applications.54 In each petition, Whedbee asserts that the applicants failed to serve copies of their amended applications on ARRL and Whedbee as required by Section 1.927(i).55 Whedbee waives the service requirement with regard to himself but notes that he cannot do so with regard to ARRL.56 Whedbee further argues that the status of the amended applications should be converted from “pending” to “submitted” and that the applications should be dismissed for failure to prosecute if the proper notice is not provided within 30 days.57 19. We decline to dismiss the amended applications or change their filing status on this basis. While applicants appear not to have served copies of the amended applications in this instance, neither Whedbee nor ARRL has shown that they lacked notice of the amended applications or was otherwise prejudiced by the omission. To the contrary, Whedbee’s petitions make clear that he was on notice of the amended applications and that he notified ARRL by serving copies of his petition.58 In the absence of any evidence of harm to Whedbee or ARRL, we conclude that dismissal of the applications is unwarranted. However, we admonish the applicants for not complying with Section 1.927(i) and expect their compliance in the future should they file further amended applications. V. CONCLUSION AND ORDERING CLAUSES 20. Based on the foregoing, we reject the petitions to deny and grant the applications listed in Appendix A in accordance with the Waiver Order and the Order on Reconsideration, and subject to the conditions specified in the Waiver Order. We remind licensees granted authorizations by this order that they must record all Recon Scout use, including date of operation, start/stop times, location of operation, frequency segment of operation, reason for use, and a point of contact.59 Licensees must provide this information to the Commission or to the National Telecommunications and Information Administration upon request of either agency.
